Chapter 211 Oregon Laws 2001
AN ACT
HB 5042
Relating to the financial
administration of the Water Resources Department; appropriating money; limiting
expenditures; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1.
There is appropriated to the Water
Resources Department, for the biennium beginning July 1, 2001, out of the
General Fund, the amount of $21,005,317 for water resources programs.
SECTION 2.
(1) In addition to and not in lieu of
any other appropriation, there is appropriated to the Water Development
Administration and Bond Sinking Fund, out of the General Fund, the sum of
$550,000.
(2) The appropriation
made by subsection (1) of this section is available continuously until expended
for the purposes specified in ORS 541.830 (1)(c).
SECTION 3.
Notwithstanding any other law, the
following amounts are established for the biennium beginning July 1, 2001, as
the maximum limits for payment of expenses from fees, moneys or other revenues,
including Miscellaneous Receipts, including federal funds received under
cooperative agreements or contracts from the Bureau of Reclamation and the Army
Corps of Engineers, United States Geological Survey, Northwest Power Planning
Council, but excluding lottery funds, collected or received by the Water
Resources Department:
(1) Water Resources Program............... $ 4,491,892
(2) Water Development Loan
Fund
Administration......................... $ 387,210
SECTION 4.
Notwithstanding any other law, the
amount of $515,000 is established for the biennium beginning July 1, 2001, as
the maximum limit for payment of expenses from federal funds collected or
received by the Water Resources Department.
SECTION 5.
Section 2 of this 2001 Act does not
limit, affect or apply to expenditures for debt service and loans for water
development projects.
SECTION 6.
Notwithstanding any other law, all
sections of this 2001 Act are subject to Oregon Department of Administrative
Services rules related to allotting, controlling, and encumbering funds.
SECTION 7.
This 2001 Act being necessary for the
immediate preservation of the public peace, health and safety, an emergency is
declared to exist, and this 2001 Act takes effect July 1, 2001.
