Chapter 333 Oregon Laws 2001
AN ACT
SB 5531
Relating to the financial
administration of the Land Use Board of Appeals; appropriating money; limiting
expenditures; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1.
There is appropriated to the Land Use
Board of Appeals, for the biennium beginning July 1, 2001, out of the General
Fund, the amount of $1,217,227.
SECTION 2.
Notwithstanding any other law, the
amount of $60,747 is established for the biennium beginning July 1, 2001, as
the maximum limit for payment of expenses from fees, moneys or other revenues,
including Miscellaneous Receipts, but excluding lottery funds and federal
funds, collected or received by the Land Use Board of Appeals.
SECTION 3.
(1) In addition to and not in lieu of
any other appropriation, there is appropriated to the Emergency Board, for the
biennium beginning July 1, 2001, out of the General Fund, the amount of
$37,433, for allocation to the Land Use Board of Appeals for continuation of a
publication editor position.
(2) If all of the moneys
referred to in subsection (1) of this section are not allocated by the
Emergency Board prior to December 1, 2002, the unallocated moneys on that date
become available for any other purpose for which the Emergency Board lawfully
may allocate funds.
SECTION 4.
Notwithstanding any other law, all
sections of this 2001 Act are subject to Oregon Department of Administrative
Services rules related to allotting, controlling, and encumbering funds.
SECTION 5.
This 2001 Act being necessary for the
immediate preservation of the public peace, health and safety, an emergency is
declared to exist, and this 2001 Act takes effect July 1, 2001.
