Chapter 426 Oregon Laws 2001
AN ACT
HB 2722
Relating to fire district
identification; creating new provisions; amending ORS 478.970, 478.972, 478.980
and 478.982; and repealing ORS 478.974, 478.976 and 478.978.
Be It Enacted by the People of the State of Oregon:
SECTION 1.
Notwithstanding ORS 478.972 (3), the
board of a fire district that possesses an identification number on the
effective date of this 2001 Act may send written notice of an identification
name for the district to the State Fire Marshal within 30 days after the
effective date of this 2001 Act.
SECTION 2.
ORS 478.970 is amended to read:
478.970. The purpose of ORS 478.970 to 478.982 is to
establish an identification [number] name for each district to be used for
statistical purposes by the State Fire Marshal and in the process of insurance
rating. [Nothing in] ORS 478.970 to
478.982 [shall be construed to] do not alter or add to the corporate
title or identification of a district organized or established by law.
SECTION 3.
ORS 478.972 is amended to read:
478.972. (1) When a district is organized the first board
shall [apply in writing to] notify the State Fire Marshal [for an] in writing of the identification [number] name for the
district.
(2) Except as
provided in this subsection, upon receipt of a written [application] notice from the board, the State Fire
Marshal shall immediately assign [to]
the district [an] the identification [number
and] name. The fire marshal
shall notify the board in writing [of the
number so assigned] if the name
conflicts with the name of another fire district in this state.
(3) The [application
shall be made by the] district board shall
notify the fire marshal as provided in subsection (1) of this section
within 30 days after the act [which] that completes the organization or
establishment of the district.
SECTION 4.
ORS 478.980 is amended to read:
478.980. In the event of a consolidation or merger of two
or more districts [which have been
assigned identification numbers, a single number shall be assigned to], the consolidated board shall select a
name for the surviving or successor district in the manner provided in ORS
478.972. [The number may be one of those
assigned to any of the districts so consolidated or merged before the act of
consolidation or merger.]
SECTION 5.
ORS 478.982 is amended to read:
478.982. In the event of a dissolution of a district, the [number] name assigned to the district [shall
be] is available for assignment
to another district.
SECTION 6.
ORS 478.974, 478.976 and 478.978 are
repealed.
