AN ACT

 

HB 5001

 

Relating to the financial administration of the State Department of Agriculture; and declaring an emergency.

 

Be It Enacted by the People of the State of Oregon:

 

          SECTION 1. For the purpose of carrying out the provisions of ORS 291.055 (1)(e), the following fee increases, approved by the Oregon Department of Administrative Services, for the State Department of Agriculture are approved as follows:

 

      (1)     Wholesale seed

               dealers.......................................   $     400 annually

      (2)     Retail sale seed

               dealers.......................................   $       40 annually

               Fruit and vegetable packers/

               shippers-regular users.............   $      28 per hour,

                                                                                    plus an

                                                                               additional

                                                                          $10 per hour

                                                                           for overtime

               Fruit and vegetable packers/

               shippers-intermittent users.....   $      35 per hour,

                                                                                    plus an

                                                                               additional

                                                                          $10 per hour

                                                                           for overtime

      (3)     Sod quality tags........................   $       0.20 per tag

      (4)     Endophyte tags-seed

               industry....................................   $       0.20 per tag

      (5)(a) Regular fees and charges

               for sampling and inspection

               of seed, hay and straw.............   $       26 per hour

      (b)    Additional lots..........................   $             4 per lot

      (6)     Fresh product grade and

               condition certification:

      (a)     All fresh fruit and

               vegetables (except onions

               and potatoes):

      (A)    20 lbs. to 65 lbs. net..................   $           0.045 per

                                                                                 container

      (B)    Bulk or bulk bins.....................   $      2.25 per ton

      (b)    Brine cherries:

      (A)    15,500 lbs. or less.....................   $                       30

      (B)    15,501 to 31,250 lbs..................   $                       35

      (C)    31,251 to 37,500 lbs..................   $                       40

      (D)    Quantities in excess of

               37,500 lbs..................................   $     0.12 per cwt.

      (c)     Onions.......................................   $   0.085 per cwt.

      (d)    Potatoes:...................................   $   0.085 per cwt.

      (A)    Certified seed...........................   $   0.085 per cwt.

      (B)    Diversion..................................   $   0.055 per cwt.

      (e)     Tree nuts:

      (A)    Filberts in-shell.........................   $   0.135 per cwt.

      (B)    Walnuts in-shell.......................   $     0.19 per cwt.

      (C)    Filbert kernels..........................   $   0.265 per cwt.

      (D)    Shelled walnuts........................   $   0.335 per cwt.

      (7)     Exotic animal permits:

      (a)     Class 1 felines, primates

               and bears..................................   $              300 for

      (b)    Class 2 felines and primates

                                                                                   product

 

          SECTION 2. This 2001 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2001 Act takes effect July 1, 2001.
