Chapter 685 Oregon Laws 2001
AN ACT
HB 5049
Relating to state financial
administration; appropriating money; limiting expenditures; and declaring an
emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1.
Notwithstanding any other law,
appropriations from the General Fund for the biennium beginning July 1, 2001,
are adjusted as follows to reflect various reductions in assessments and rates:

SECTION 2.
Notwithstanding any other law limiting
expenditures for payment of expenses from fees, moneys or other revenues,
including Miscellaneous Receipts, but excluding lottery funds and federal
funds, for the biennium beginning July 1, 2001, the limitations for certain
state agencies are adjusted as follows to reflect various reductions in
assessments and rates:

SECTION 2a.
Notwithstanding any other law, the
limitation on expenditures established by section 2, chapter 14, Oregon Laws
2001 (Enrolled House Bill 5004), for the biennium beginning July 1, 2001, as
the maximum limit for payment of expenses for administration, grants and
services supplied to veterans from the Oregon War Veterans’ Bond Sinking Account
and the Miscellaneous Receipts Account of the Department of Veterans’ Affairs
is reduced by $56,714 to reflect various reductions in assessments and rates.
SECTION 3.
Notwithstanding any other law limiting
expenditures from federal funds for the biennium beginning July 1, 2001, the
limitations for certain state agencies are adjusted as follows to reflect
various reductions in assessments and rates:

SECTION 4.
Notwithstanding any other law, the
limitation on expenditures established by section 2, chapter 469, Oregon Laws
2001 (Enrolled Senate Bill 5532), for the biennium beginning July 1, 2001, as
the maximum limit for payment of expenses from fees, moneys or other revenues,
including Miscellaneous Receipts, but excluding lottery funds and federal
funds, collected or received by the State Landscape Contractors Board, is
increased by $53,881 to pay the cost of the transition to semi-independent
state agency status for the last quarter of 2002.
SECTION 5.
Notwithstanding any other law, the
limitation on expenditures established by section 2, chapter 58, Oregon Laws
2001 (Enrolled House Bill 5022), for the biennium beginning July 1, 2001, as
the maximum limit for payment of expenses from fees, moneys or other revenues,
including Miscellaneous Receipts, but excluding lottery funds and federal
funds, collected or received by the Department of Justice, is increased by
$403,977 for the purposes of allowing the department to assume responsibility
on October 1, 2001, for ongoing investigations of certain types of Social
Security fraud.
SECTION 6.
Notwithstanding any other law, the
limitation on expenditures established by section 2 (1), chapter 80, Oregon
Laws 2001 (Enrolled Senate Bill 5502), for the biennium beginning July 1, 2001,
as the maximum limit for payment of expenses from fees, moneys or other
revenues, including Miscellaneous Receipts, but excluding lottery funds and
federal funds, collected or received by the Oregon Department of Administrative
Services for operating expenses, is increased by $41,274 for the Office for
Oregon Health Plan Policy and Research.
SECTION 7.
Notwithstanding any other law, the
limitation on expenditures established by section 3, chapter 80, Oregon Laws
2001 (Enrolled Senate Bill 5502), for the biennium beginning July 1, 2001, as
the maximum limit for the payment of expenses from federal funds, collected or
received by the Oregon Department of Administrative Services, is increased by
$314,000 for the Office for Oregon Health Plan Policy and Research.
SECTION 8.
Notwithstanding any other law, the
limitation on expenditures established by the Emergency Board on September 8,
2000, acting under authority of ORS 291.326 (1), for the biennium beginning
July 1, 1999, as the maximum limit for the payment of expenses from federal
funds, collected or received by the Oregon Department of Administrative
Services for the Office for Oregon Health Plan Policy and Research, is reduced
by $314,000.
SECTION 9.
Notwithstanding any other law, the
limitation on expenditures established by section 2 (3), chapter 80, Oregon
Laws 2001 (Enrolled Senate Bill 5502), for the biennium beginning July 1, 2001,
as the maximum limit for payment of expenses from fees, moneys or other
revenues, including Miscellaneous Receipts, but excluding lottery funds and
federal funds, collected or received by the Oregon Department of Administrative
Services for the Oregon Center for Electronic Commerce and Government, is
increased by $2,490,147.
SECTION 10.
Notwithstanding any other law, all
sections of this 2001 Act are subject to Oregon Department of Administrative
Services rules related to allotting, controlling and encumbering funds.
SECTION 11.
Sections 1 to 7, 9 and 10 of this 2001
Act become operative on July 1, 2001.
SECTION 12.
This 2001 Act being necessary for the
immediate preservation of the public peace, health and safety, an emergency is
declared to exist, and this 2001 Act takes effect on its passage.
