Chapter 706 Oregon Laws 2001
AN ACT
HB 3410
Relating to commercial
driver training schools; amending ORS 336.790, 336.800 and 336.815; and
declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1.
ORS 336.790 is amended to read:
336.790. As used in ORS 336.790 to 336.815, unless the
context requires otherwise:
(1) “Commercial
driver training school” means a school operated by a person issued a commercial
driver training school certificate by the Department of Transportation under
ORS 822.515.
[(1)] (2) “Facility” means any facility for
the deaf operated under ORS 346.010, the Hillcrest School of Oregon and the
MacLaren School.
[(2)] (3) “Private school” means a private
or parochial high school.
[(3)] (4) “Public school” means a common or
union high school district, education service district and a community college
district.
SECTION 2.
ORS 336.800 is amended to read:
336.800. (1) Any private school, [or] public
school, [or] facility or commercial
driver training school may offer a course in traffic safety education. The
curriculum for the traffic safety education course shall be established by the
Department of Transportation under ORS 802.345.
(2) A person employed to teach a traffic safety education
course must meet qualifications established by the department under ORS
802.345.
SECTION 3.
ORS 336.815 is amended to read:
336.815. Any public school may contract with a [lawfully licensed private] commercial driver training school for
the instruction of students enrolled in a traffic safety education course.
SECTION 4.
This 2001 Act being necessary for the
immediate preservation of the public peace, health and safety, an emergency is
declared to exist, and this 2001 Act takes effect July 1, 2001.
