Chapter 760 Oregon Laws 2001
AN ACT
HB 2268
Relating to fees charged for
tests performed in state public health laboratory; amending ORS 431.310; and
declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1.
ORS 431.310 is amended to read:
431.310. (1) For the better protection of the public health
the laboratory of the Health Division shall make bacteriological and other
examinations of water, milk, blood, secretions or tissues required by any
state, county or city institution, or officer, and may make such examinations
for any licensed physician in accordance with the rules of the division.
(2) The division shall establish by rule and collect fees
for tests performed in the state public health laboratory, not to exceed:
(a) $50 per test for
tests other than newborn screening tests; and
(b) $30 per specimen for
newborn screening tests.
[(a) $16 per specimen
for various newborn screening tests;]
[(b) $35 per specimen
for mycology and virology tests; and]
[(c) $40 per specimen
for reference culture tests.]
(3) All money received for such tests shall be deposited in
the Health Division Account to be used for expenses of the [division] state public health laboratory.
SECTION 2.
This 2001 Act being necessary for the
immediate preservation of the public peace, health and safety, an emergency is
declared to exist, and this 2001 Act takes effect on its passage.
