Chapter 768 Oregon Laws 2001
AN ACT
SB 5519
Relating to the financial
administration of the State Forestry Department; appropriating money; limiting
expenditures; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1.
There is appropriated to the State
Forestry Department, for the biennium beginning July 1, 2001, out of the
General Fund, the following amounts for the following purposes:
(1) Agency administration......... $ 7,004,899
(2) Protection from fire............. $ 16,815,067
(3) Forestry assistance............... $ 1,836,168
(4) Forest practices.................... $ 8,791,267
(5) Capital improvement........... $ 85,488
(6) Debt service.......................... $ 1,848,102
SECTION 2.
Notwithstanding any other law, the
following amounts are established for the biennium beginning July 1, 2001, as
the maximum limits for payment of expenses from fees, moneys or other revenues,
including Miscellaneous Receipts, excluding lottery funds but including federal
funds from the U.S. Forest Service for fire protection and for research
projects, collected or received by the State Forestry Department, for the
following purposes:
(1) Agency administration......... $ 11,239,399
(2) Protection from fire............. $ 50,955,184
(3) State-owned forest lands..... $ 56,634,281
(4) Forestry assistance............... $ 3,168,703
(5) Forest practices.................... $ 6,738,956
(6) Capital improvement........... $ 3,791,463
(7) Debt service.......................... $ 1,125,515
(8) Forest nursery...................... $ 6,317,233
(9) Equipment pool.................... $ 12,597,671
SECTION 3.
Notwithstanding any other law, the
amount of $3,554,566 is established for the biennium beginning July 1, 2001, as
the maximum limit for the payment of expenses from federal funds collected or
received by the State Forestry Department.
SECTION 4.
In addition to and not in lieu of any
other appropriation, there is appropriated to the Emergency Board, for the
biennium beginning July 1, 2001, out of the General Fund, the amount of
$800,000 for allocation to the State Forestry Department for expenditures
related to emergency forest fire suppression. If any moneys appropriated under
this section remain unallocated by the Emergency Board on December 1, 2002,
those unallocated moneys become available for any other purpose for which the
Emergency Board lawfully may allocate moneys.
SECTION 5.
Notwithstanding any other law limiting
expenditures of the State Forestry Department for the payment of expenses of
the department from fees, moneys or other revenues, including
Miscellaneous Receipts, but including federal funds for fire protection,
excluding lottery funds, collected or received by the department, the
limitation on expenditures for the biennium ending June 30, 2001, established
by section 2 (2), chapter 892, Oregon Laws 1999, as modified by the Emergency
Board, is increased by $7,200,000.
SECTION 6.
Section 2 of this 2001 Act does not limit,
affect or apply to expenditures for the equalization of emergency fire
suppression costs from the Oregon Forest Land Protection Fund or the purchase
of insurance referred to in ORS 477.775. This 2001 Act does not limit, affect
or apply to expenditures for fire cost claims.
SECTION 7.
Notwithstanding any other law, all
sections of this 2001 Act are subject to Oregon Department of Administrative
Services rules related to allotting, controlling, and encumbering funds.
SECTION 8.
This 2001 Act being necessary for the
immediate preservation of the public peace, health and safety, an emergency is
declared to exist, and this 2001 Act takes effect July 1, 2001.
