Chapter 769 Oregon Laws 2001
AN ACT
SB 5504
Relating to the financial
administration of the State Department of Agriculture; appropriating money;
limiting expenditures; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1.
(1) There are appropriated to the State
Department of Agriculture, for the biennium beginning July 1, 2001, out of the
General Fund, the following amounts for the following purposes:
(a) Agency operations................ $ 22,036,630
(b) Debt service.......................... $ 168,795
(2) Within the
appropriation made by subsection (1)(a) of this section, payment is authorized
for expenses of the State Department of Agriculture in connection with
entertainment for furthering economic development.
SECTION 2.
Notwithstanding any other law, the
amount of $42,146,706 is established for the biennium beginning July 1, 2001,
as the maximum limit for payment of expenses from fees, moneys or other
revenues, including Miscellaneous Receipts, and including federal funds for
contract services, collected or received by the State Department of Agriculture
for agency operations.
SECTION 3.
Notwithstanding any other law, the
amount of $3,758,105 is established for the biennium beginning July 1, 2001, as
the maximum limit for payment of expenses from lottery moneys allocated from
the Parks and Natural Resources Fund to the State Department of Agriculture for
the Oregon Plan to restore salmon and watershed activities.
SECTION 4.
Notwithstanding any other law, the
amount of $3,772,363 is established for the biennium beginning July 1, 2001, as
the maximum limit for payment of expenses from federal funds collected or
received by the State Department of Agriculture.
SECTION 5.
In addition to and not in lieu of any
other appropriation, there is appropriated to the Emergency Board, for the
biennium beginning July 1, 2001, out of the General Fund, the amount of
$1,484,228 for allocation to the State Department of Agriculture for
expenditures related to the development of a pesticide use reporting system. If
any moneys appropriated under this section remain unallocated on December 1,
2002, those unallocated moneys become available for any other purpose for which
the Emergency Board lawfully may allocate moneys.
SECTION 6.
Notwithstanding any other law, all
sections of this 2001 Act are subject to Oregon Department of Administrative
Services rules related to allotting, controlling, and encumbering funds.
SECTION 7.
This 2001 Act being necessary for the
immediate preservation of the public peace, health and safety, an emergency is
declared to exist, and this 2001 Act takes effect July 1, 2001.
