Chapter 774 Oregon Laws 2001

 

AN ACT

 

SB 5517

 

Relating to the financial administration of the Department of Environmental Quality; appropriating money; limiting expenditures; and declaring an emergency.

 

Be It Enacted by the People of the State of Oregon:

 

          SECTION 1. There is appropriated to the Department of Environmental Quality, for the biennium beginning July 1, 2001, out of the General Fund, the following amounts for the following purposes:

 

           (1)     Air Quality............................ $     5,168,182

           (2)     Water Quality....................... $   20,102,255

           (3)     Waste Management

                    and Cleanup......................... $     2,087,036

           (4)     Cross Media.......................... $          82,355

           (5)     Agency Management........... $        247,563

           (6)     Debt Service.......................... $   14,399,945

 

          SECTION 2. Notwithstanding any other law, the following amounts are established for the biennium beginning July 1, 2001, as the maximum limit for payment of expenses from fees, moneys or other revenues, including the proceeds of bonds for the Orphan Site Account and federal funds from the Bureau of Land Management and U.S. Forest Service for smoke monitoring laboratory services, collected or received by the Department of Environmental Quality, for the following purposes:

 

           (1)     Air Quality............................ $   33,029,329

           (2)     Water Quality....................... $   14,715,457

           (3)     Waste Management

                    and Cleanup......................... $   43,162,355

           (4)     Cross Media.......................... $        541,582

           (5)     Agency Management........... $   17,592,601

 

          SECTION 3. Notwithstanding any other law, the amount of $305,510 is established for the biennium beginning July 1, 2001, as the maximum limit for the payment of expenses from lottery moneys from the Administrative Services Economic Development Fund to the Department of Environmental Quality for the payment of debt service on clean water state revolving fund lottery bonds.

 

          SECTION 4. Notwithstanding any other law, the amount of $192,000 is established for the biennium beginning July 1, 2001, as the maximum limit for the payment of expenses from lottery moneys from the Parks and Natural Resources Fund to the Department of Environmental Quality for the lower Columbia River estuary project.

 

          SECTION 5. Section 2 of this 2001 Act does not limit, affect or apply to expenditures for debt service paid from Other Funds, for loans made from the Pollution Control Fund or for loans made from the Water Pollution Control Revolving Fund.

 

          SECTION 6. Notwithstanding any other law, the following amounts are established for the biennium beginning July 1, 2001, as the maximum limit for the payment of expenses from federal funds collected or received by the Department of Environmental Quality, for the following purposes:

 

           (1)     Air Quality............................ $     6,390,023

           (2)     Water Quality....................... $   12,481,551

           (3)     Waste Management

                    and Cleanup......................... $   15,142,217

           (4)     Cross Media.......................... $        429,318

 

          SECTION 7. Notwithstanding any other law limiting expenditures of the Department of Environmental Quality for the payment of expenses of the department from lottery funds received from the Administrative Services Economic Development Fund, for the biennium ending June 30, 2001, the limitation on expenditures for underground storage tank financial assistance programs established by Emergency Board action in October 1999 is increased by $7,000.

 

          SECTION 8. Notwithstanding any other law, all sections of this 2001 Act are subject to Oregon Department of Administrative Services rules related to allotting, controlling, and encumbering funds.

 

          SECTION 9. This 2001 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2001 Act takes effect July 1, 2001.
