Chapter 814 Oregon Laws 2001

 

AN ACT

 

HB 5043

 

Relating to state financial administration; creating new provisions; amending section 5, chapter 776, Oregon Laws 2001 (Enrolled Senate Bill 5538); appropriating money; limiting expenditures; and declaring an emergency.

 

Be It Enacted by the People of the State of Oregon:

 

          SECTION 1. Of the moneys deposited into the Watershed Improvement Operating Fund established under ORS 541.379, the Oregon Watershed Enhancement Board shall allocate $3,952,074 to the Department of State Police for fish and wildlife activities to implement section 4 (5), Article XV of the Oregon Constitution.

 

          SECTION 2. Of the moneys deposited into the Watershed Improvement Operating Fund established under ORS 541.379, the Oregon Watershed Enhancement Board shall allocate $3,942,273 to the State Department of Fish and Wildlife for activities and projects to implement section 4 (5), Article XV of the Oregon Constitution.

 

          SECTION 3. Of the moneys deposited into the Watershed Improvement Operating Fund established under ORS 541.379, the Oregon Watershed Enhancement Board shall allocate $2,400,000 to the State Department of Agriculture for activities and projects to implement section 4 (5), Article XV of the Oregon Constitution.

 

          SECTION 4. Of the moneys deposited into the Watershed Improvement Operating Fund established under ORS 541.379, the Oregon Watershed Enhancement Board shall allocate $192,000 to the Department of Environmental Quality for activities and projects to implement section 4 (5), Article XV of the Oregon Constitution.

 

          SECTION 5. Notwithstanding any other law, the amount of $6,578,488 is established for the biennium beginning July 1, 2001, as the maximum limit for the payment of expenses by the Oregon Watershed Enhancement Board from lottery moneys deposited into the Watershed Improvement Grant Fund established under ORS 541.397 for operating expenses, activities and projects to implement section 4 (5), Article XV of the Oregon Constitution.

 

          SECTION 6. Of the moneys deposited into the Watershed Improvement Grant Fund established under ORS 541.397, the Oregon Watershed Enhancement Board shall allocate $770,000 to the Department of State Police for expenses of implementing section 4 (5), Article XV of the Oregon Constitution.

 

          SECTION 7. Of the moneys deposited into the Watershed Improvement Grant Fund established under ORS 541.397, the Oregon Watershed Enhancement Board shall allocate $1,233,105 to the State Department of Agriculture for activities and projects to implement section 4 (5), Article XV of the Oregon Constitution.

 

          SECTION 8. Notwithstanding any other law, the amount of $1 is established for the biennium beginning July 1, 2001, as the maximum limit for payment of expenses from lottery funds collected or received by the Oregon Watershed Enhancement Board from the Restoration and Protection Research Fund.

 

          SECTION 9. Notwithstanding any other law, the amount of $9,145,875 is established for the biennium beginning July 1, 2001, as the maximum limit for payment of expenses for agency operations related to Oregon Plan activities from federal funds collected or received by the Oregon Watershed Enhancement Board.

 

          SECTION 10. Notwithstanding any other law, the amount of $8,020,000 is established for the biennium beginning July 1, 2001, as the maximum limit for payment of expenses for agency operations related to Oregon Plan activities from federal funds carried over from the 1999-2001 biennium for the Oregon Watershed Enhancement Board.

 

          SECTION 11. The appropriation for the biennium ending June 30, 2001, made pursuant to section 14, chapter 910, Oregon Laws 1999, from the General Fund to the Oregon Watershed Enhancement Board for assessment and monitoring, is reduced by $1,501,788.

 

          SECTION 12. In addition to and not in lieu of any other appropriation, there is appropriated to the Oregon Watershed Enhancement Board, out of the General Fund, for the biennium beginning July 1, 2001, the amount of $375,000 for assessment and monitoring.

 

          SECTION 13. Notwithstanding any other law, the amount of $1,249,995 is established for the biennium beginning July 1, 2001, as the maximum limit for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, excluding lottery funds and federal funds, for agency operations related to Oregon Plan activities collected or received by the Oregon Watershed Enhancement Board.

 

          SECTION 14. Notwithstanding any other law, the amount of $1,024,944 is established for the biennium beginning July 1, 2001, as the maximum limit for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, excluding lottery funds and federal funds, carried over from the 1999-2001 biennium for the Oregon Watershed Enhancement Board.

 

          SECTION 15. In addition to and not in lieu of any other appropriation, there is appropriated to the Emergency Board, out of the General Fund, for the biennium beginning July 1, 2001, the amount of $1,126,788 for allocation to the Oregon Watershed Enhancement Board for assessment and monitoring projects committed to during the biennium ending June 30, 2001. If any of the moneys appropriated under this section remain unallocated by the Emergency Board on June 30, 2002, those unallocated moneys become available for any other purpose for which the Emergency Board lawfully may allocate moneys.

 

          SECTION 16. If Senate Bill 5538 becomes law, section 5, chapter 776, Oregon Laws 2001 (Enrolled Senate Bill 5538), is amended to read:

          Sec. 5. Notwithstanding any other law, the amount of [$3,410,292] $4,722,074 is established for the biennium beginning July 1, 2001, as the maximum limit for payment of fish and wildlife activities and operations expenses from moneys or other revenues allocated to the Parks and Natural Resources Fund from lottery funds made available under section 4 (5), Article XV of the Oregon Constitution.

 

          SECTION 17. (1) The Oregon Watershed Enhancement Board shall establish by rule a process for allocating available moneys in the Restoration and Protection Subaccount of the Parks and Natural Resources Fund on a quarterly basis to fulfill the biennial allocations made in this 2001 Act. Except as provided in subsection (2) of this section, all quarterly allocations shall be set at one-eighth of the biennial allocations.

          (2) If, in any quarter, the moneys transferred from the State Lottery Fund to the Parks and Natural Resources Fund are insufficient to pay for the quarterly allocations established under this 2001 Act, these allocations shall be reduced proportionately in sufficient amounts to accommodate the revenue shortfall.

 

          SECTION 18. Notwithstanding any other law, all sections of this 2001 Act are subject to Oregon Department of Administrative Services rules related to allotting, controlling and encumbering funds.

 

          SECTION 19. This 2001 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2001 Act takes effect on its passage.
