Chapter 878 Oregon Laws 2001
AN ACT
HB 5014
Relating to state financial
administration; creating new provisions; amending section 1b, chapter 829,
Oregon Laws 2001 (Enrolled House Bill 2877), and section 4, chapter 208, Oregon
Laws 2001 (Enrolled House Bill 5024); appropriating money; limiting
expenditures; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1.
(1) In addition to and not in lieu of
any other appropriation, there is appropriated to the Emergency Board, for the
biennium beginning July 1, 2001, out of the General Fund, the amount of
$40,000,000 for the purposes for which the Emergency Board lawfully may
allocate such moneys.
(2)(a) In addition to
and not in lieu of any other appropriation, there is appropriated to the
Emergency Board, for the biennium beginning July 1, 2001, out of the General
Fund, the following sums to be allocated by the Emergency Board to affected
state agencies for the purposes of paying:
(A) To the Department of
Higher
Education for the
College of
Veterinary
Medicine at
Oregon
State
University.................... $ 4,000,000
(B) To the Department of
Human Services
for the
Home Care
Commission...... $ 300,000
(C) To the Department of
Human Services
for
local mental
health
planning and
services........... $ 7,500,000
(b) If any of the
moneys appropriated in paragraph (a) of this subsection are not allocated by
the Emergency Board prior to November 1, 2002, the remaining moneys on that
date become available for any other purpose for which the Emergency Board
lawfully may allocate funds.
(3)(a) If Senate Bills
819 and 9 become law, in addition to and not in lieu of any other
appropriation, there is appropriated to the Emergency Board, for the biennium
beginning July 1, 2001, out of the General Fund, the amount of $7,016,628 to be
allocated to the Department of Human Services.
(b) If any of the moneys
appropriated in paragraph (a) of this subsection are not allocated prior to
November 1, 2002, the remaining moneys on that date become available for any
other purpose for which the Emergency Board lawfully may allocate funds.
SECTION 2.
In addition to and not in lieu of any
other appropriation, there is appropriated to the Emergency Board, out of the
General Fund, the amount of $100,000,000 to be allocated by the Emergency Board
to state agencies for state employee compensation changes for the biennium
beginning July 1, 2001.
SECTION 3.
In addition to and not in lieu of any
other appropriation, there is appropriated to the Department of Transportation,
for the biennium beginning July 1, 2001, out of the General Fund, the following
amounts for the following purposes:
(1) Willamette Valley High
Speed Rail
Program............. $ 921,009
(2) Senior and Disabled
Transportation..................... $ 921,009
SECTION 4.
In addition to and not in lieu of any
other appropriation, there is appropriated to the Oregon Student Assistance
Commission, for the biennium beginning July 1, 2001, out of the General Fund,
the amount of $5,100,000.
SECTION 5.
(1) Notwithstanding any other law, the
amount appropriated to the Oregon Government Standards and Practices
Commission, out of the General Fund, by section 1, chapter 378, Oregon Laws
1999, for the biennium beginning July 1, 1999, as modified by the Emergency
Board, is increased by $31,500.
(2) Notwithstanding any
other law, the amount appropriated to the Oregon Government Standards and
Practices Commission, out of the General Fund, by section 1, chapter 129,
Oregon Laws 2001 (Enrolled House Bill 5019), for the biennium beginning July 1,
2001, is reduced by $31,500.
SECTION 6.
(1) In addition to and not in lieu of
any other appropriation, there is appropriated to the Department of Justice,
for the biennium beginning July 1, 2001, out of the General Fund, the amount of
$204,011.
(2) Notwithstanding any
other law, the limitation on expenditures established by section 3, chapter 58,
Oregon Laws 2001 (Enrolled House Bill 5022), for the biennium beginning July 1,
2001, as the maximum limit for payment of expenses from federal funds collected
or received by the Department of Justice, is increased by $610,172.
SECTION 7.
In addition to and not in lieu of any
other appropriation, there is appropriated to the Oregon Department of
Administrative Services, for the biennium beginning July 1, 2001, out of the
General Fund, the following amounts for the following purposes:
(1) World Affairs Council

SECTION 8.
If Senate Bill 5527 becomes law, in
addition to and not in lieu of any other appropriation, there is appropriated
to the Oregon Department of Administrative Services, for the biennium beginning
July 1, 2001, out of the General Fund, the amount of $2,066,617.
SECTION 9.
If Senate Bill 5527 becomes law, in
addition to and not in lieu of any other appropriation, there is appropriated
to the Department of Land Conservation and Development, for the biennium
beginning July 1, 2001, out of the General Fund, the amount of $620,019.
SECTION 10.
If Senate Bill 5527 becomes law, in
addition to and not in lieu of any other appropriation, there is appropriated
to the Department of Environmental Quality, for the biennium beginning July 1,
2001, out of the General Fund, the amount of $785,500.
SECTION 11.
If Senate Bill 5527 becomes law, in
addition to and not in lieu of any other appropriation, there is appropriated
to the Dispute Resolution Commission, for the biennium beginning July 1, 2001,
out of the General Fund, the amount of $119,284.
SECTION 12.
In addition to and not in lieu of any
other appropriation, there is appropriated to the Department of State Police,
for the biennium beginning July 1, 2001, out of the General Fund, the amount of
$500,000.
SECTION 13.
In addition to and not in lieu of any
other appropriation, there is appropriated to the Oregon Criminal Justice
Commission, for the biennium beginning July 1, 2001, out of the General Fund,
the amount of $141,422.
SECTION 14.
In addition to and not in lieu of any
other appropriation, there is appropriated to the Oregon Watershed Enhancement
Board, for the biennium beginning July 1, 2001, out of the General Fund, the
amount of $500,000.
SECTION 15.
In addition to and not in lieu of any
other appropriation, there is appropriated to the Department of Community
Colleges and Workforce Development, for the biennium beginning July 1, 2001,
out of the General Fund, the amount of $1,500,000.
SECTION 16.
In addition to and not in lieu of any
other appropriation, there is appropriated to the Secretary of State, for the
biennium beginning July 1, 2001, out of the General Fund, the amount of
$1,000,000.
SECTION 17.
In addition to and not in lieu of any
other appropriation, there is appropriated to the Division of State Lands, for
the biennium beginning July 1, 2001, out of the General Fund, the amount of
$100,000.
SECTION 18.
In addition to and not in lieu of any
other appropriation, there is appropriated to the Oregon Youth Authority, for
the biennium beginning July 1, 2001, out of the General Fund, the amount of
$203,840.
SECTION 19.
In addition to and not in lieu of any
other appropriation, there is appropriated to the Department of Corrections,
for the biennium beginning July 1, 2001, out of the General Fund, the amount of
$267,000.
SECTION 20.
(1) In addition to and not in lieu of
any other appropriation, there is appropriated to the Judicial Department, for
the biennium beginning July 1, 2001, out of the General Fund, the amount of
$7,326,253.
(2) Notwithstanding any
other law, the limitation on expenditures established by section 3, chapter
130, Oregon Laws 2001 (Enrolled House Bill 5020), for the biennium beginning
July 1, 2001, as the maximum limit for payment of expenses from fees, moneys or
other revenues, including Miscellaneous Receipts, but excluding lottery funds
and federal funds, collected or received by the Judicial Department, is
increased by $1,395,589.
(3) Notwithstanding any
other law, the limitation on expenditures established by section 4, chapter
130, Oregon Laws 2001 (Enrolled House Bill 5020), for the biennium beginning
July 1, 2001, as the maximum limit for the payment of expenses from federal
funds collected or received by the Judicial Department, is increased by
$416,357.
SECTION 21.
(1) In addition to and not in lieu of
any other appropriation, there is appropriated to the Department of Human
Services, for the biennium beginning July 1, 2001, out of the General Fund, the
following amounts for the following purposes:
(a) Medical Assistance
Programs.............................. $ 10,754,185
(b) Public Health Programs...... $ 304,000
(c) Vocational Rehabilitation
Programs.............................. $ 1,300,000
(d) Director’s Office................... $ 275,000
(e) Mental Health Services........ $ 100,000
(f) Adult and Family
Services................................. $ 100,000
(2) Notwithstanding
any other law, the limitation on expenditures established by section 4 (2)(c),
chapter 892, Oregon Laws 2001 (Enrolled Senate Bill 5527), for the biennium
beginning July 1, 2001, as the maximum limit for the payment of expenses from federal
funds collected or received by the Department of Human Services for Medical
Assistance Programs, is increased by $15,750,377.
SECTION 22.
In addition to and not in lieu of any
other appropriation, there is appropriated to the Office of the Governor, for
the biennium beginning July 1, 2001, out of the General Fund, the amount of
$200,000.
SECTION 23.
In addition to and not in lieu of any
other appropriation, there is appropriated to the Economic and Community
Development Department, for the biennium beginning July 1, 2001, out of the
General Fund, the amount of $320,000.
SECTION 24.
Notwithstanding any other law, the
amount appropriated to the Department of Higher Education, out of the General
Fund, by section 1, chapter 891, Oregon Laws 2001 (Enrolled Senate Bill 5524),
for the biennium beginning July 1, 2001, is reduced by $1,000,000.
SECTION 25.
Notwithstanding any other law, the
amount appropriated to the Department of Education, out of the General Fund, by
section 1 (1), chapter 799, Oregon Laws 2001 (Enrolled Senate Bill 5511), for
the biennium beginning July 1, 2001, is reduced by $200,000.
SECTION 26.
Notwithstanding any other law, the
limitation on expenditures established by section 3 (1), chapter 692, Oregon
Laws 2001 (Enrolled House Bill 5015), for the biennium beginning July 1, 2001,
as the maximum limit for the payment of expenses from federal funds collected
or received by the Employment Department, is increased by $7,400,000.
SECTION 27.
Notwithstanding any other law, the
limitation on expenditures established by section 2 (2), chapter 776, Oregon
Laws 2001 (Enrolled Senate Bill 5538), for the biennium beginning July 1, 2001,
as the maximum limit for payment of expenses from fees, moneys or other
revenues, including Miscellaneous Receipts, but excluding lottery funds and
federal funds, collected or received by the Department of State Police for Fish
and Wildlife activities and operations, is increased by $910,019.
SECTION 28.
Section 4, chapter 208, Oregon Laws 2001 (Enrolled House Bill 5024), is amended
to read:
Sec. 4.
Notwithstanding any other law limiting expenditures of the Division of State
Lands for the payment of expenses from fees, moneys or other revenues,
including Miscellaneous Receipts, but excluding lottery funds and federal
funds, collected or received by the Division of State Lands for the biennium
ending June 30, 2001, the limitation on expenditures established by section [3]
2 (3), chapter 635, Oregon Laws 1999, for Common School Fund programs, as
modified by Emergency Board action, is increased by $50,000.
SECTION 29.
Section 1b, chapter 829, Oregon Laws 2001 (Enrolled House Bill 2877), is
amended to read:
Sec. 1b.
Notwithstanding ORS 137.300, for the biennium beginning on July 1, 2001, the
Department of Revenue shall distribute:
(1) 70.35 percent of the moneys in the Criminal Fine and
Assessment Account, reduced by the
amount reported by the Department of Justice to the Department of Revenue under
ORS 137.300 (4), to the General Fund to be used for general governmental
expenses; and
(2) 29.65 percent of the moneys in the account to the
Criminal Fine and Assessment Public Safety Fund established in section 2, chapter 829, Oregon Laws 2001 (Enrolled
House Bill 2877) [of this 2001 Act].
SECTION 30.
(1) If Senate Bill 819 becomes law, and
notwithstanding any other law, the amount appropriated to the Department of
Human Services for Medical Assistance Programs, out of the General Fund, by
section 1 (2)(c), chapter 892, Oregon Laws 2001 (Enrolled Senate Bill 5527),
for the biennium beginning July 1, 2001, is reduced by $7,016,628.
(2) If Senate Bill 819
becomes law, and notwithstanding any other law, the limitation on expenditures
established by section 4 (2)(c), chapter 892, Oregon Laws 2001 (Enrolled Senate
Bill 5527), for the Department of Human Services for Medical Assistance
Programs, is reduced by $10,277,827.
SECTION 31.
(1) There is transferred from the Health
Care Trust Fund, established in section 1, chapter 986, Oregon Laws 2001
(Enrolled House Bill 3951), to the Oregon Department of Administrative
Services, the amount of $5,000,000.
(2) Notwithstanding any
other law, the limitation on expenditures established by section 2 (1), chapter
80, Oregon Laws 2001 (Enrolled Senate Bill 5502), for the biennium beginning
July 1, 2001, as the maximum limit for payment of expenses from fees, moneys or
other revenues, including Miscellaneous Receipts, but excluding lottery funds
and federal funds, collected or received by the Oregon Department of
Administrative Services, is increased by $5,000,000 for the purposes of a
special payment to the Oregon Resource and Technology Development Subaccount,
established in section 7 (1), chapter 922, Oregon Laws 2001 (Enrolled House
Bill 3968).
SECTION 32.
Notwithstanding any other law, all
sections of this 2001 Act are subject to Oregon Department of Administrative
Services rules related to allotting, controlling and encumbering funds.
SECTION 33.
This 2001 Act being necessary for the
immediate preservation of the public peace, health and safety, an emergency is
declared to exist, and this 2001 Act takes effect on July 1, 2001.
