Chapter 880 Oregon Laws 2001
AN ACT
HB 5051
Relating to state financial
administration; appropriating money; limiting expenditures; and declaring an
emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1.
There is appropriated to the Department
of Community Colleges and Workforce Development, for the biennium beginning
July 1, 2001, out of the General Fund, the amount of $2,659,258 for operations.
SECTION 2.
There is appropriated to the Department
of Community Colleges and Workforce Development, for the biennium beginning
July 1, 2001, out of the General Fund, the amount of $463,318,191 for the
Community College Support Fund for distribution to community college districts
and community college service districts pursuant to ORS 341.626.
SECTION 3.
In addition to and not in lieu of any
other appropriation, there is appropriated to the Department of Community
Colleges and Workforce Development, for the biennium beginning July 1, 2001,
out of the General Fund, the amount of $2,250,000 for the following programs:
(1) For the Sabin Skills
Center of the
North Clackamas
School
District........................... $ 1,030,000
(2) For regional partnerships
between
community colleges
and state
institutions of
higher
education under the
State Board of
Higher
Education.................................. $ 1,220,000
SECTION 4.
Notwithstanding any other law, the
amount of $7,977,580 is established for the biennium beginning July 1, 2001, as
the maximum limit for payment of expenses from fees, moneys or other revenues,
including Miscellaneous Receipts, but excluding lottery funds and federal
funds, collected or received by the Department of Community Colleges and
Workforce Development. The limitation imposed by this section does not include
fees, moneys or other revenues collected or received by the Department of
Community Colleges and Workforce Development for the Oregon Youth Conservation
Corps.
SECTION 5.
Notwithstanding any other law, the
amount of $1,610,715 is established for the biennium beginning July 1, 2001, as
the maximum limit for payment of expenses from fees, moneys or other revenues,
including Miscellaneous Receipts, but excluding lottery funds and federal
funds, collected or received by the Department of Community Colleges and
Workforce Development for the Oregon Youth Conservation Corps.
SECTION 6.
In addition to and not in lieu of any
other appropriation, there is appropriated to the Department of Community
Colleges and Workforce Development, for the biennium beginning July 1, 2001,
out of the General Fund, the amount of $448,661 for the Oregon Youth
Conservation Corps.
SECTION 7.
In addition to and notwithstanding any
other law, the amount of $1,782,400 is established for the biennium beginning
July 1, 2001, as the maximum limit for payment of expenses by the Department of
Community Colleges and Workforce Development from moneys received from the
Western Oregon Timber Tax Account, the Western Oregon Timber Tax Reserve
Account and the Eastern Oregon Timber Tax Account for the Community College
Support Fund.
SECTION 8.
Notwithstanding any other law, the
amount of $119,092,725 is established for the biennium beginning July 1, 2001,
as the maximum limit for payment of expenses from federal funds collected or
received by the Department of Community Colleges and Workforce Development.
SECTION 9.
In addition to and not in lieu of any
other appropriation, there is appropriated to the Department of Community
Colleges and Workforce Development, for the biennium beginning July 1, 2001,
out of the General Fund, the amount of $4,352,085, which may be expended only
for debt service on the outstanding general obligation bonds sold pursuant to
Article XI-G of the Oregon Constitution.
SECTION 10.
Of the amounts appropriated under
section 2 of this 2001 Act, $259,500,000 is considered to be tax relief for
purposes of ORS 291.355.
SECTION 11.
Of the amounts distributed to the public
school system from the Community College Support Fund pursuant to ORS 341.626
for the fiscal year beginning July 1, 2001, by section 2 of this 2001 Act, an
amount equal to the amount determined by the Department of Revenue to be the
amount of reduction pursuant to ORS 310.228 for community college districts and
community college service districts is specifically designated as replacement
revenue within the meaning of section 11 (9), Article XI of the Oregon
Constitution. If any additional amounts are distributed from the Community
College Support Fund pursuant to ORS 341.626 for the fiscal year beginning July
1, 2001, these amounts are not replacement revenue within the meaning of
section 11 (9), Article XI of the Oregon Constitution.
SECTION 12.
Of the amounts distributed to the public
school system from the Community College Support Fund pursuant to ORS 341.626
for the fiscal year beginning July 1, 2002, by section 2 of this 2001 Act, an
amount equal to the amount determined by the Department of Revenue to be the
amount of reduction pursuant to ORS 310.228 for community college districts and
community college service districts is specifically designated as replacement
revenue within the meaning of section 11 (9), Article XI of the Oregon
Constitution. If any additional amounts are distributed from the Community
College Support Fund pursuant to ORS 341.626 for the fiscal year beginning July
1, 2002, these amounts are not replacement revenue within the meaning of
section 11 (9), Article XI of the Oregon Constitution.
SECTION 13.
Notwithstanding any other law limiting
expenditures of the Department of Community Colleges and Workforce Development
for the payment of expenses of the Oregon Youth Conservation Corps from fees,
moneys or other revenues, including Miscellaneous Receipts, but excluding
lottery funds and federal funds, for the biennium beginning July 1, 1999, the
limitation on expenditures for the Department of Community Colleges and
Workforce Development established by section 4a, chapter 219, Oregon Laws 1999,
as modified by Emergency Board action, is increased by $258,343.
SECTION 14.
Notwithstanding any other law, all
sections of this 2001 Act are subject to Oregon Department of Administrative
Services rules related to allotting, controlling, and encumbering funds.
SECTION 15.
This 2001 Act being necessary for the
immediate preservation of the public peace, health and safety, an emergency is
declared to exist, and this 2001 Act takes effect on its passage.
