Chapter 891 Oregon Laws 2001
AN ACT
SB 5524
Relating to the financial
administration of Department of Higher Education; appropriating money; limiting
expenditures; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1.
There is appropriated to the Department
of Higher Education, for the biennium beginning July 1, 2001, out of the
General Fund, the amount of $675,323,930, which may be expended for support of
education and general services of higher education.
SECTION 2.
Notwithstanding any other law, the
amount of $665,745,330 is established for the biennium beginning July 1, 2001,
as the maximum limit for payment of expenses from fees, moneys or other
revenues, including Miscellaneous Receipts, but excluding lottery funds and
federal funds, collected or received by the Department of Higher Education for
support of education and general services of higher education.
SECTION 3.
Notwithstanding any other law, the
amount of $76,840,000 is established for the biennium beginning July 1, 2001,
as the maximum limit for payment of expenses from fees, moneys or other
revenues, including Miscellaneous Receipts, but excluding lottery funds and
federal funds, collected or received by the Department of Higher Education for
fee remissions.
SECTION 4.
Sections 1 to 3 of this 2001 Act do not
prohibit the Department of Higher Education or the State Board of Higher
Education from expending moneys in addition to the appropriations and
limitations made by sections 1 to 3 of this 2001 Act if such additional moneys
are otherwise available as provided by law for expenditure by the department or
board for gift, grant and contract activities, noncredit continuing education,
auxiliary enterprise activities, user fee supported education and public
service activities, student aid programs excluding fee remissions.
SECTION 5.
Notwithstanding any other law, the
amount of $5,408,887 is established for the biennium beginning July 1, 2001, as
the maximum limit for payment of expenses from funds allocated to the
Department of Higher Education from the Sports Lottery Account.
SECTION 6.
In addition to and not in lieu of any
other appropriation, there is appropriated to the Department of Higher
Education, for the biennium beginning July 1, 2001, out of the General Fund,
the sum of $21,547,547, which may be expended only for debt service and
administrative costs relating to debt service on outstanding general obligation
bonds sold pursuant to Article XI-G of the Oregon Constitution.
SECTION 7.
Notwithstanding any other law, the
amount of $838,570 is established for the biennium beginning July 1, 2001, as
the maximum limit for payment of expenses by the Department of Higher Education
from lottery moneys allocated from the Administrative Services Economic
Development Fund for debt service on outstanding lottery bonds.
SECTION 8.
In addition to and not in lieu of any
other appropriation, there are appropriated to the Department of Higher
Education, for the biennium beginning July 1, 2001, out of the General Fund,
the following amounts, which may be expended only for the following purposes:
(1) For support of the
Agricultural Experiment Station and the branch experiment stations of Oregon
State University, $56,053,393.
(2) For support of the
Extension Service of Oregon State University, $38,607,292.
(3) For support of the
Forest Research Laboratory of Oregon State University, $5,551,929.
SECTION 9.
Notwithstanding any other law, the
following amounts are established for the biennium beginning July 1, 2001, as
the maximum limits for payment of expenses from fees, moneys or other revenues,
including Miscellaneous Receipts, but excluding lottery funds and federal
funds, collected or received by the Department of Higher Education, for the
following purposes:
(1) For support of the
Agricultural Experiment Station and the branch experiment stations of Oregon
State University, $15,105,886.
(2) For support of the
Extension Service of Oregon State University, $22,420,111.
(3) For support of the
Forest Research Laboratory of Oregon State University, $8,908,284.
SECTION 10.
Sections 8 and 9 of this 2001 Act do not
prohibit the Department of Higher Education or the State Board of Higher
Education from expending moneys in addition to the appropriations and limitations
made by sections 8 and 9 of this 2001 Act if such additional moneys are
otherwise available as provided by law for expenditure by the department or
board for gift, grant and contract activities and user fee supported public
service activities.
SECTION 11.
Notwithstanding any other law limiting
expenditures of the Department of Higher Education for the payment of expenses
from fees, moneys or other revenues, including Miscellaneous Receipts, but
excluding lottery funds and federal funds, for the biennium beginning July 1,
1999, the limitation on expenditures for the Department of Higher Education for
support of education and general services of higher education established by
section 2, chapter 899, Oregon Laws 1999, as modified by Emergency Board
action, is increased by $39,587,905.
SECTION 12.
Notwithstanding any other law, sections
1 to 5 and 8 to 11 of this 2001 Act are subject to Oregon Department of
Administrative Services rules related to allotting, controlling and encumbering
funds.
SECTION 13.
This 2001 Act being necessary for the
immediate preservation of the public peace, health and safety, an emergency is
declared to exist, and this 2001 Act takes effect on its passage.
