Chapter 892 Oregon Laws 2001

 

AN ACT

 

SB 5527

 

Relating to state financial administration; appropriating money; limiting expenditures; and declaring an emergency.

 

Be It Enacted by the People of the State of Oregon:

 

          SECTION 1. There is appropriated to the Department of Human Services, for the biennium beginning July 1, 2001, out of the General Fund, the amount of $2,499,024,746 to be expended for:

 

           (1)     Economic Independence and

                    Family Stability Services

                    as follows:

           (a)     Adult and Family

                    Services................................. $ 187,501,252

           (b)    Services to Children

                    and Families.......................... $ 231,488,325

           (c)     Alcohol and Drug Abuse

                    Programs.............................. $   32,896,341

           (d)    Vocational Rehabilitation

                    Programs.............................. $   13,827,972

           (2)     Health Services as follows:

           (a)     Public Health Programs...... $   30,483,610

           (b)    Mental Health Services........ $ 375,946,880

           (c)     Medical Assistance

                    Programs.............................. $ 734,455,820

           (3)     Long Term Care and Developmental

                    Disability Services as follows:

           (a)     Senior and Disabled

                    Services................................. $ 517,339,315

           (b)    Developmental Disability

          SECTION 2. Notwithstanding any other law, the amount of $7,145,478 is established for the biennium beginning July 1, 2001, as the maximum limit for the payment of expenses from lottery moneys allocated from the Administrative Services Economic Development Fund to Alcohol and Drug Abuse Programs for gambling addiction treatment and prevention.

 

          SECTION 3. Notwithstanding any other law, the amount of $874,119,108 is established for the biennium beginning July 1, 2001, as the maximum limit for the payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, tobacco tax receipts and Medicare receipts and federal funds for indirect cost recovery, collected or received by the Department of Human Services for:

 

           (1)     Economic Independence and

          SECTION 4. Notwithstanding any other law, the amount of $4,349,830,109 is established for the biennium beginning July 1, 2001, as the maximum limit for the payment of expenses from federal funds, collected or received by the Department of Human Services for:

 

           (1)     Economic Independence and

                    Family Stability Services

                    as follows:

           (a)     Adult and Family

          SECTION 5. Notwithstanding any other law, the amount of $124,000,000 is established for the biennium beginning July 1, 2001, as the maximum limit for payment of expenses from moneys transferred to the Department of Human Services from the Tobacco Settlement Funds Account established by section 1, chapter 977, Oregon Laws 2001 (Enrolled House Bill 2450), for Medical Assistance Programs.

 

          SECTION 6. Sections 3 and 4 of this 2001 Act do not limit, affect or apply to expenditures for Women, Infant and Children Nutrition Program food vouchers, federal food stamp benefit payments and Community Health Insurance Program reimbursable drug purchases.

 

          SECTION 7. This 2001 Act does not prohibit the Department of Human Services from transferring funds and expenditure limitations among programs identified in a single subsection of section 1, 3 or 4 of this 2001 Act or, for Mental Health and Developmental Disability Services programs identified in section 1 (2) and (3), 3 (2) and (3), 4 (2) and (3) or 6 of this 2001 Act.

 

          SECTION 8. Notwithstanding ORS 411.010 and 413.029, the funds appropriated by this 2001 Act may not be used to meet the costs of burials, except for persons in the care and custody of the Department of Human Services.

 

          SECTION 9. (1) In addition to and not in lieu of any other appropriation, there is appropriated to the Emergency Board, for the biennium beginning July 1, 2001, out of the General Fund, the amount of $32,689,324 for allocation to the Department of Human Services for the following purposes:

 

           (a)     Developmental Disability

                    Services for a state-operated

                    crisis group home or alternative

                    services for developmentally

                    disabled adults in the 2002-

                    2003 fiscal year..................... $        317,124

           (b)    Developmental Disability

                    Services for community

                    program costs in the 2002-2003

                    fiscal year for the plan for

                    universal access to services

                    for people with developmental

                    disabilities.............................. $   19,172,200

           (c)     Medical Assistance Programs

                    for unfunded caseload growth

                    or unrealized savings from

                    implementation of

                    prescription drug cost

                    containment measures......... $     6,700,000

           (d)    Medical Assistance Programs

                    for safety net clinics............. $     2,200,000

           (e)     Adult and Family Services

                    for potential caseload

                    issues...................................... $     4,300,000

 

          (2) If any of the moneys described in subsection (1) of this section are not allocated by the Emergency Board for the purposes described in subsection (1) of this section prior to November 1, 2002, such unallocated moneys on that date become available for any other purpose for which the Emergency Board may lawfully allocate funds.

 

          SECTION 10. Notwithstanding any other law, all sections of this 2001 Act are subject to Oregon Department of Administrative Services rules related to allotting, controlling and encumbering funds.

 

          SECTION 11. This 2001 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2001 Act takes effect July 1, 2001.
