Chapter 980 Oregon Laws 2001
AN ACT

Relating to Oregon Health
Plan; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1.
Sections 2 and 3 of this 2001 Act are
added to and made a part of ORS chapter 414.
SECTION 2.
(1) When a woman who is enrolled in the
Oregon Health Plan as a pregnant woman becomes an inmate residing in a public
institution, the Department of Human Services shall suspend medical assistance
under the plan.
(2) The department shall
continue to determine the eligibility of the pregnant woman as categorically
needy as defined in ORS 414.025.
(3) Upon notification
that a pregnant woman described under subsection (1) of this section is no
longer an inmate residing in a public institution, the department shall
reinstate medical assistance under the plan if the woman is otherwise eligible
for medical assistance.
SECTION 3.
Section 2 of this 2001 Act does not extend eligibility to an otherwise
ineligible individual or extend medical assistance to an individual if matching
federal funds are not available to pay for medical assistance.
SECTION 4.
This 2001 Act being necessary for the
immediate preservation of the public peace, health and safety, an emergency is
declared to exist, and this 2001 Act takes effect on its passage.
