Chapter 985 Oregon Laws 2001
AN ACT
HB 3847
Relating to the
establishment of a Veterans Memorial; limiting expenditures; and declaring an
emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1.
(1) The Oregon Department of Administrative
Services shall establish a Veterans Memorial in the State Capitol Mall area.
(2) In accordance with
ORS 276.038, the Capitol Planning Commission shall advise the Oregon Department
of Administrative Services on the establishment of the Veterans Memorial
required under subsection (1) of this section.
SECTION 2.
(1) There is created the Veterans
Memorial Council to advise the Capitol Planning Commission on the cost, design,
placement and construction of the Veterans Memorial required under section 1 of
this 2001 Act. The council shall consist of five members, to be appointed as
follows:
(a) The Speaker of the
House of Representatives shall appoint one member of the House of
Representatives;
(b) The President of the
Senate shall appoint one member of the Senate; and
(c) The Governor,
Speaker of the House of Representatives and President of the Senate shall each
appoint one member of the public who is a veteran or the family member of a
veteran.
(2) A member appointed
to the council serves at the pleasure of the appointing authority. If there is
a vacancy for any cause, the appointing authority shall make an appointment to
become immediately effective.
(3) A majority of the
members of the council constitutes a quorum for the transaction of business.
(4) The council shall
select one of its members as chairperson and another as vice-chairperson, with
duties and powers necessary for the performance of the functions of such
offices as the council determines.
(5) The council shall
meet at times and places specified by the call of the chairperson or of a
majority of the members of the council.
(6) The Capitol Planning
Commission shall provide staff necessary for the functions of the council.
SECTION 3.
Notwithstanding any other law, the
amount of $15,000 is established for the biennium beginning July 1, 2001, as
the maximum limit for payment of expenses from fees, moneys or other revenues,
including Miscellaneous Receipts, but excluding lottery funds and federal
funds, collected or received by the Oregon Department of Administrative
Services for planning of a Veterans Memorial in the State Capitol Mall area.
SECTION 4.
Sections 1 to 3 of this 2001 Act are
repealed July 1, 2005.
SECTION 5.
This 2001 Act being necessary for the
immediate preservation of the public peace, health and safety, an emergency is
declared to exist, and this 2001 Act takes effect July 1, 2001.
