SUMMARY
The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure.
Allocates portion of net proceeds from state lottery for
financial support of county fairs. Sunsets county fair allocation
on July 1, 2009. Changes alternative effective date for
distribution of certain moneys for financial support of county
fairs.
A BILL FOR AN ACT
Relating to financing of county fairs; creating new provisions;
and amending section 3, chapter 796, Oregon Laws 1995.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + The Legislative Assembly finds and declares
that:
(1) The activities of county fairs promote Oregon's
agricultural industry and its products;
(2) The promotion of agricultural products expands markets,
which in turn creates jobs and stimulates economic development of
the industry;
(3) Annual county fairs and county fairgrounds draw patrons
from throughout the state and create jobs and substantial
economic activity for areas where fairgrounds are located;
(4) Annual county fairs provide important opportunities to
expand educational offerings for, and to develop self-confidence
and personal responsibility in, Oregon youth;
(5) Annual county fairs are vital to fostering community pride
and involve tens of thousands of Oregon citizens as exhibitors
and volunteers; and
(6) Annual county fairs allow community nonprofit organizations
to raise critical funds that are reinvested in vital public
service programs. + }
SECTION 2. { + (1) Subject only to the availability of
unobligated net lottery proceeds, there shall be allocated from
the Administrative Services Economic Development Fund to the
County Fair Account created under ORS 565.445 an amount equal to
1.2 percent of the net proceeds from the Oregon State Lottery.
Notwithstanding ORS 565.445, moneys allocated to the County Fair
Account under this section are appropriated continuously to the
County Fair Commission solely for the purpose of carrying out of
section 3 of this 2001 Act, including the payment of
administrative costs.
(2) The allocation of moneys from the Administrative Services
Economic Development Fund under this section is subject to the
requirements in section 4, Article XV of the Oregon Constitution,
for deposit of 15 percent of the net proceeds from the Oregon
State Lottery into the Education Endowment Fund and into the
parks and natural resources fund and shall be made only after
satisfaction or payment of:
(a) Amounts allocated to Westside lottery bonds issued under
ORS 391.140 or to the reserves or any refunding related to the
Westside lottery bonds in accordance with the priority for
allocation and disbursement established by ORS 391.130;
(b) All liens, pledges or other obligations relating to lottery
bonds or refunding lottery bonds that are due or payable during
the biennium beginning July 1, 2001; and
(c) Amounts required by any other pledges of, or liens on, net
proceeds from the Oregon State Lottery. + }
SECTION 3. { + (1) The County Fair Commission shall make
annual distributions of the moneys allocated to the County Fair
Account under section 2 of this 2001 Act. Notwithstanding ORS
565.425, the commission shall distribute the moneys in grants of
equal amount to each county possessing a fair fund established
pursuant to ORS 565.325.
(2) Notwithstanding ORS 565.445 and subsection (1) of this
section, those moneys allocated to the County Fair Account
pursuant to section 2 of this 2001 Act that are in excess of $3.6
million for any biennium shall be transferred and credited to the
Oregon County Fair Account established under ORS 565.455. + }
SECTION 4. Section 3, chapter 796, Oregon Laws 1995, is amended
to read:
{ + Sec. 3. + } Section 2 { + , chapter 796, Oregon Laws
1995, + } { - of this Act - } first becomes operative on July
1, { - 2003 - } { + 2009 + }, or on the July 1 next following
the date on which the balance in the Oregon County Fair Account
reaches $40 million, whichever occurs first.
SECTION 5. { + Sections 1 to 3 of this 2001 Act are repealed
July 1, 2009. + }
