Requires State Department of Agriculture to adopt rules
governing selling and purchasing of grass seed crops.
A BILL FOR AN ACT
Relating to commercial transactions involving grass seed.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + Notwithstanding ORS 576.705, the State
Department of Agriculture shall adopt rules governing the selling
and purchasing of annual and perennial grass seed crops. The
rules shall include, but need not be limited to:
(1) Requirements that the purchaser of a grass seed crop make
whole or partial payment for the crop within specified times
following the occurrence of one or more identifiable events. The
rules must also set forth the conditions, if any, under which an
agricultural producer may waive the specified time for payment.
(2) Procedures for agricultural producer resale of a grass seed
crop following whole or partial nonpayment by a purchaser. For a
grass seed crop that is subject to the Plant Variety Protection
Act (7 U.S.C. 2321 to 2582 (1999 Edition)), the department shall
adopt rules that are consistent with 7 U.S.C. 2541(b) (1999
Edition) or other provisions of federal law to the extent the
department determines the federal law to be applicable. The
department may revise rules adopted under this section from time
to time as the department considers necessary. + }
