                             SUMMARY
 
The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.
 
  Imposes cutoff date for persons qualifying under 1997 law as
exempt from home inspector certification requirement. Limits
uncertified practice of home inspection. Allows persons exempted
from home inspector certification program opportunity to obtain
certification without meeting certain criteria.
 
                        A BILL FOR AN ACT
Relating to home inspectors; creating new provisions; and
  repealing section 3b, chapter 814, Oregon Laws 1997.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + Section 2 of this 2001 Act is added to and made
a part of ORS chapter 701. + }
  SECTION 2.  { + (1) Notwithstanding ORS 701.350 (1), an
individual may work as a home inspector without certification if:
  (a) The individual was registered under this chapter (1997
Edition) as a general contractor in each year from January 1,
1991, through August 11, 1997;
  (b) The individual delivers notice to the Construction
Contractors Board on or before February 1, 2002, that the
individual is seeking exemption from the certification
requirement; and
  (c) The home inspection is conducted:
  (A) Prior to January 1, 2003; or
  (B) For a purpose other than to facilitate a transfer of real
estate.
  (2) Notwithstanding ORS 701.350 (3), an individual who is
exempt from certification under subsection (1) of this section
and who passes the home inspector examination prior to January 1,
2003, may become certified as a home inspector without meeting
the education and training requirements otherwise required by the
board for the issuance of home inspector certification. + }
  SECTION 3.  { + Section 3b, chapter 814, Oregon Laws 1997, is
repealed. + }
