                             SUMMARY

  Modifies participants' access to benefits in Oregon JOBS
individual education accounts. { +  Requires Oregon Student

program to inform JOBS Plus participants about moneys available
for education, training and other services. + }
 
                        A BILL FOR AN ACT
Relating to Oregon JOBS individual education accounts; creating
  new provisions; and amending ORS 411.877 and 411.894.
Be It Enacted by the People of the State of Oregon:
  SECTION 1. ORS 411.894 is amended to read:
  411.894. (1) The Oregon JOBS Individual Education Account is
established  { + in the Department of Human Services + } in order
to improve the position of JOBS Plus participants in the
workforce by increasing their access to   { - continuing - }
education { +  and training + }.  Employer contributions to the
account under this section shall be used to pay for education
 { + and training + } expenses for the
  { - individual - }   { + participant and the participant's
immediate family + } as provided in subsection (2) of this
section.
  (2)(a) After the participant has participated in the JOBS Plus
Program for 30 days, the employer shall pay, in addition to the
participant wage, one dollar for each participant hour worked
into the participant's individual education account.
Contributions to such an account shall be tax deferred or
tax-exempt to the extent permitted by federal and state law.
  (b) Any participant for whom an Oregon JOBS Individual
Education Account contribution is made  { + or a member of the
participant's immediate family + }   { - shall be - }
 { + is + } eligible for access to education  { + and
training + } benefits from that participant's individual
education account for { + :
  (A) + } Up to five years after the participant has left the
JOBS Plus Program   { - and has held a full-time, unsubsidized
job for at least 30 days - }  { +  if the participant has not
notified the Oregon Student Assistance Commission of the intent
to use the moneys; or
  (B) Up to 10 years after the participant has left the JOBS Plus
Program if the participant has notified the commission within
five years after leaving the program of the intent to use the
moneys + }.
  (c)   { - When any participant has qualified for use of that
participant's individual education account, - }   { + The
department shall transfer + } an amount equal to that
participant's individual education account balance   { - shall be
transferred - }  to the Oregon Student Assistance Commission for
that participant's use { +  within 30 days after the participant
has left the JOBS Plus Program + }. Only one individual education
account shall be created for any participant. Each account shall
be administered by the Oregon Student Assistance Commission and
shall be used for continuing education and training for the
participant and the participant's immediate family.
   { +  (3) After establishing an individual education account
for a participant, the Oregon Student Assistance Commission shall
provide to each participant information regarding the need grant
program described in ORS 348.260 and the Individual Education and
Training Scholarship Account program established under section 4
of this 2001 Act. + }
    { - (3) - }   { + (4) + } The Oregon Student Assistance
Commission may use any interest earned by the account for payment
of expenses incurred by the commission in carrying out its duties
under this section.
    { - (4) - }   { + (5)(a) Unless the commission has received
notice under subsection (2) of this section, the commission shall
transfer + } any unexpended or unobligated moneys remaining in an
individual education account five years after the participant has
left the JOBS Plus Program   { - are appropriated and
transferred - }  to the
  { - Oregon State Need Grant Fund - }   { + Individual Education
and Training Scholarship Account + } on that date.
   { +  (b) The commission shall transfer any unexpended or
unobligated moneys remaining in an individual education account
10 years after the participant has left the JOBS Plus Program to
the Oregon State Need Grant Fund. + }
  SECTION 2. ORS 411.894, as amended by section 17, chapter 1070,
Oregon Laws 1999, is amended to read:
  411.894. (1) The Oregon JOBS Individual Education Account is
established  { + in the Department of Human Services + } in order
to improve the position of JOBS Plus participants in the
workforce by increasing their access to   { - continuing - }

account under this section shall be used to pay for education

  SECTION 3.  { + Sections 4 and 5 of this 2001 Act are added to
and made a part of ORS 411.877 to 411.896. + }
  SECTION 4.  { + (1) + }  { + The Individual Education and
Training Scholarship Account is established in the Department of
Human Services. The purpose of the account is to provide funds
for:
  (a) Training for JOBS Plus participants and their immediate
family; and
  (b) Training for low income populations identified by the
Department of Human Services and the Employment Department.
  (2) The Department of Human Services and the Employment
Department jointly shall adopt rules establishing eligibility
requirements and procedures to receive funds from the Individual
Education and Training Scholarship Account. + }
  SECTION 5.  { + A JOBS Plus participant may request funds from
the Oregon Student Assistance Commission to attend an education
and training program. If a participant requests funds for a
post-secondary education and training program, the Oregon Student
Assistance Commission shall provide the funding for the request.
If a participant requests funds for an education and training
program that is not a post-secondary education program, the
Oregon Student Assistance Commission shall transfer the amount
requested by the participant from the participant's individual
education account to the Individual Education and Training
Scholarship Account. + }
  SECTION 6. ORS 411.877 is amended to read:
 
  411.877. As used in ORS 316.680, 411.877 to 411.896 and
657.925 { +  and sections 4, 5 and 7 of this 2001 Act + }:
  (1) 'Board' means the JOBS Plus Advisory Board established in
ORS 411.886.
  (2) 'Department' means the Department of Human Services.
   { +  (3) 'Education and training program' means courses or a
program of study conducted by a public or private provider in one
or more of the following areas:
  (a) Occupational skills;
  (b) Adult education and family literacy;
  (c) Professional technical training;
  (d) Retraining services;
  (e) Skill upgrade services;
  (f) Workplace-related instruction;
  (g) Instruction in English language skills for individuals with
limited English proficiency;
  (h) Entrepreneurial training; and
  (i) Basic skills.
  (4) 'Immediate family' means father, mother, child, sibling,
parent, spouse, grandparent, stepparent and stepchild. + }
    { - (3) - }   { + (5) + } 'JOBS Plus' or 'program' means the
JOBS Plus Program established in ORS 411.878.
  SECTION 7.  { + (1) The Oregon Student Assistance Commission
shall consult with the Education and Workforce Policy Advisor to
develop an outreach program to inform participants of the moneys
that are available for education and training programs and career
and occupational services available from workforce partners.
  (2) The commission shall adopt rules to implement subsection
(1) of this section. + }
  SECTION 8.  { + The Department of Human Services shall transfer
all moneys held in the Oregon JOBS Individual Education Account
to the Oregon Student Assistance Commission on the effective date
of this 2001 Act. + }
