                             SUMMARY
 
The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.
 
  Establishes Court Productivity and Access Improvement Revolving
Account in State Treasury. Provides that account consists in part
of funds attributable to savings realized from implementation of
productivity projects and quality improvement projects.
Appropriates moneys in account to Judicial Department.  Provides
for implementation of certain court projects.
 
                        A BILL FOR AN ACT
Relating to Court Productivity and Access Improvement Revolving
  Account; and appropriating money.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + The Legislative Assembly finds that:
  (1) It is in the public interest to encourage and promote state
court initiatives for improving public access to courts and court
services; and
  (2) The present state budgeting system does not adequately
allow for timely and positive improvements in court programs and
processes. + }
  SECTION 2.  { + (1) The Court Productivity and Access
Improvement Revolving Account is established in the State
Treasury, separate and distinct from the General Fund. Interest
earned by the account shall be credited to the account. All
moneys in the account are appropriated continuously to the
Judicial Department for making loans, grants, matching funds or
cash awards available to state courts upon authorization of the
State Court Administrator for:
  (a) Implementation of court productivity projects and quality
improvement projects; and
  (b) Public outreach and improvements in public access to court
services.
  (2) The Court Productivity and Access Improvement Revolving
Account shall consist of:
  (a) Funds attributable to savings realized from implementation
of court productivity projects and quality improvement projects,
whether authorized by the department before, on or after the
effective date of this 2001 Act;
  (b) Jury per diem and mileage expense payments waived by jurors
in the manner provided by ORS 10.075;
  (c) Interest earned on the account; and
  (d) Such other amounts as may be appropriated to the account
from time to time.
  (3) Documented budget savings resulting from improved
efficiency or effectiveness shall be credited to the Court
Productivity and Access Improvement Revolving Account and used
for program improvements by the department. If not used in the
biennium in which the savings occur, the amount of credit to the
department may be treated as continuously appropriated to the
department and may be expended in the following biennium without
resulting in any budget justification for the department.
Expenditures from the account are not subject to allotment or
other budgetary procedures. An expenditure from the account
during a biennium shall not be considered to be within any
appropriation or expenditure limitation in the department's
budget for the biennium.
  (4) A productivity project may include training, education,
employee development and judge development authorized by the
department and designed to promote improved productivity.
  (5) In preparing the department's budget for a biennium
following the biennium in which the department credits any amount
to the Court Productivity and Access Improvement Revolving
Account, the department shall identify any reduction or offset in
department expenses resulting from improved efficiency. The
department shall include in the budget a report of the programs
or projects funded from the Court Productivity and Access
Improvement Revolving Account. + }
  SECTION 3.  { + There is appropriated to the Judicial
Department, out of the General Fund, the sum of $___, for deposit
in the Court Productivity and Access Improvement Revolving
Account established under section 2 of this 2001 Act. The moneys
appropriated under this section may be expended by the department
only for the purposes specified for moneys in the Court
Productivity and Access Improvement Revolving Account under
section 2 of this 2001 Act. This appropriation is available
continuously until expended for the purposes specified in this
