  On page 1 of the printed bill, line 3, delete '19.440 and'.
  In line 7, after the period insert 'The provisions of this
section apply to all proceedings in the action or suit, including
arbitration, trial and appeal.'.
  In line 9, delete 'or' and insert a comma and after ' decree'
insert 'or arbitration award'.
  In line 11, after 'court' insert 'or arbitrator'.
  In line 13, after 'court' insert 'or arbitrator'.
  In line 14, delete 'if the court decides to make the award'.
  Delete lines 15 and 16 and insert:
  ' (c) Decide the amount of the award of attorney fees on claims
for which the court or arbitrator is required to award attorney
fees; and'.
  After line 22, insert:
  ' (4) This section does not create a claim to an award of
attorney fees in any action or suit in which the court or

  Delete line 36 and insert:
