                             SUMMARY
 
The following summary is not prepared by the sponsors of the

consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.
 
  Directs Oregon Criminal Justice Commission to amend rules to
prohibit optional probation sentences for persons convicted of
certain drug offenses.
  Appropriates moneys from General Fund to Emergency Board for
further allocation to Department of Corrections.
  Declares emergency, effective July 1, 2001.
 
                        A BILL FOR AN ACT
Relating to manufacture of controlled substances; appropriating
  money; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + No later than January 1, 2002, the Oregon
Criminal Justice Commission shall amend its rules and appendices
to prohibit persons convicted of manufacturing substantial
quantities of methamphetamine or amphetamine from being eligible
for an optional probation sentence. + }
  SECTION 2.  { + In addition to and not in lieu of any other
appropriation, there is appropriated to the Emergency Board, for
the biennium beginning July 1, 2001, out of the General Fund, the
amount of $56,242 for allocation only to the Department of
Corrections, after the April 2002 prison population forecast, for
population management issues resulting from implementation of
section 1 of this 2001 Act. Any moneys that remain unallocated
and unobligated by the Emergency Board on November 1, 2002,
become available for any purpose for which the Emergency Board
lawfully may allocate funds. + }
  SECTION 3.  { + This 2001 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2001 Act takes effect July 1,
2001. + }
