  On page 1 of the printed bill, line 2, after 'utilities '
insert '; and declaring an emergency'.
  In line 4, delete '1, 2 and 3' and insert '1 to 4'.
  In line 12, delete 'cutting' and insert 'pruning'.
  In line 14, after 'if' insert 'the pruning or removal is
consistent with policies of the Public Utility Commission
relating to the pruning or removal of vegetation, or is
consistent with a local ordinance or resolution applicable to the
property that relates to the pruning or removal of vegetation,
and'.
  In line 16, delete 'Cutting' and insert 'Pruning'.
  In line 19, delete 'cutting' and insert 'pruning'.
  In line 22, delete 'cutting' and insert 'pruning'.
  In line 24, after 'if' insert 'the pruning or removal is
consistent with policies of the Public Utility Commission
relating to the pruning or removal of vegetation, or is
consistent with a local ordinance or resolution applicable to the
property that relates to the pruning or removal of vegetation,
and any of the following apply'.
  In line 25, delete 'cut' and insert 'pruned'.
  Delete lines 27 and 28 and insert 'trical hazard under any
electrical safety code adopted by the Public Utility Commission
or constitutes a danger under state or federal health and safety
codes to a person working on the facilities or with access to the
facilities.'.
  In line 29, delete 'A qualified forester or arborist has
determined that'.
  In line 30, delete 'and' and insert 'or is' and delete '
trimming' and insert 'pruning'.
  On page 2, line 1, after 'facilities' insert a period and
delete the rest of the line and line 2 and insert 'A
determination under this paragraph must be made by a qualified
forester or arborist if a local ordinance or resolution requires
that such determinations be made by a qualified forester or
arborist.'.
  In line 3, delete 'A qualified forester or arborist has
determined that'.
  In line 5, after the period insert 'A determination under this
paragraph must be made by a qualified forester or arborist if a
local ordinance or resolution requires that such determinations
be made by a qualified forester or arborist.'.
  In line 10, delete 'cut' and insert 'prune'.
  After line 14, insert:
  ' (3) The limitation on liability provided by this section does
not apply unless the pruning or removal complies with the
American National Standard for Tree Care Operations, ANSI
A300-1995, as adopted by the American National Standards
Institute and in effect on the effective date of this 2001 Act.
  '  { +  SECTION 4. + }  { + The immunities provided by sections
1 to 3 of this 2001 Act do not affect any liability that an
electric utility may have for the costs of abating fires under
ORS 477.064 to 477.120. + } ' .
  In line 15, delete '4' and insert '5' and delete '3 ' and
insert '4'.
  After line 16, insert:

the immediate preservation of the public peace, health and
safety, an emergency is declared to exist, and this 2001 Act
takes effect on its passage. + } ' .
