                             SUMMARY

  Requires county clerk to file record of marriage solemnized
outside United States. Specifies that date of marriage be
included on marriage certificate.
 
                        A BILL FOR AN ACT
Relating to recording of foreign marriage certificates; amending
  ORS 106.165 and 106.180.
Be It Enacted by the People of the State of Oregon:
  SECTION 1. ORS 106.165 is amended to read:
  106.165. (1) The Assistant Director for Health by rule shall
prescribe a standard form of the marriage certificate to be used
in this state. The certificate shall contain the names and
addresses of the parties and of at least two witnesses, the
 { - time - }  { + date + } and place of the marriage, the
signature of the person who solemnized the marriage  { - , - }
 { + and + } the date of the license for the marriage and by whom
issued.
  (2) The form shall be of such size and appearance as to
emphasize the importance of the event   { - which - }
 { + that + } it evidences and the significance of the pioneer
heritage of this state.
  (3) In carrying out the duties imposed by subsections (1) and
(2) of this section, the Assistant Director for Health shall
consult with the county clerks and may authorize a competition
among graphic artists to prepare the form to be prescribed.
  SECTION 2. ORS 106.180 is amended to read:
  106.180. (1) The county clerk shall file the certificate
  { - mentioned - }   { + described + } in ORS 106.170 and record
it in the record of marriages. No fee shall be charged for such
filing, recording or indexing.
   { +  (2) The county clerk shall file a certificate of marriage
or other official record of a marriage solemnized outside the
United States in the record of marriages. If the certificate or
other official record of a marriage is in a language other than
the English language, it shall be accompanied by a written form
indicating, in the English language, the names and addresses of
the parties and the date and place of the marriage. + }

of law, the record of marriage maintained by a county clerk is
 
not a vital record as defined by ORS 432.005 and is a public
record open and subject to full disclosure.
