                             SUMMARY
 
The following summary is not prepared by the sponsors of the

brief statement of the essential features of the measure.
 
    { - Repeals duplicate statute relating to individualized
education program for special education. - }
   { +  Establishes pilot program for enhancement of English as a
Second Language programs.
  Declares emergency, effective July 1, 2001. + }
 
                        A BILL FOR AN ACT
Relating to education; appropriating money; and declaring an
  emergency.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + (1) There is established a pilot program for
enhancement of English as a Second Language programs. The goal of
the pilot program is to explore quicker methods of moving
non-English-speaking students into mainstream classes while
retaining bilingual support for students. The pilot program shall
be for the 2001-2002 and 2002-2003 school years.
  (2) The Department of Education shall select one middle school
for participation in the pilot program. The middle school shall
have an existing English as a Second Language program that
targets non-English-speaking students with a goal of moving those
students into mainstream classrooms. Some of the students in the
program shall be in their first year of enrollment in an Oregon
public school.
  (3) The Department of Education shall award a grant to the
school district of the participating middle school. The school
district shall use grant funds received through the pilot program
to enhance English as a Second Language programs at the
participating middle school and may use the grant funds for:
  (a) Establishing a computer lab or purchasing additional
computers for the pilot program;
  (b) Purchasing software;
  (c) Providing staff with technical support;
  (d) Purchasing audio books;
  (e) Purchasing audio and visual equipment;
  (f) Establishing a parent literacy program; and
  (g) Payment of any other costs attributable to the enhancement
of the program.
 
  (4) At the end of the pilot program, the school district of the
participating middle school shall report to the legislative
committees on education of the Seventy-second Legislative
Assembly and the State Board of Education. The report shall
include:
  (a) An evaluation of the program;
  (b) An evaluation of the program's impact on the students;
  (c) Recommendations about the program;
  (d) Costs of the program; and
  (e) Any other relevant information. + }
  SECTION 2.  { + In addition to and not in lieu of any other
appropriation, there is appropriated to the Department of
Education, for the biennium beginning July 1, 2001, out of the
General Fund, the amount of $225,000 for the purpose of awarding
a grant to a school district participating in the pilot program
for enhancing English as a Second Language programs under section
1 of this 2001 Act. + }
  SECTION 3.  { + This 2001 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2001 Act takes effect July 1,
2001. + }
