brief statement of the essential features of the measure as
introduced.
 
  Creates crime of falsifying drug test results. Punishes by
maximum of six months' imprisonment, $2,000 fine, or both.
  Creates crime of providing drug test falsification equipment.
Punishes by maximum of one year's imprisonment, $5,000 fine, or
both.
 
                        A BILL FOR AN ACT
Relating to controlled substances.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + Sections 2 and 3 of this 2001 Act are added to
and made a part of ORS 475.940 to 475.995. + }
  SECTION 2.  { + (1) A person commits the crime of falsifying
drug test results if the person intentionally uses, or possesses
with intent to use, any substance or device designed to falsify
the results of a drug test of the person.
  (2) Falsifying drug test results is a Class B misdemeanor.
  (3) As used in sections 2 and 3 of this 2001 Act, 'drug test'
means a lawfully administered test designed to detect the
presence of a controlled substance. + }
  SECTION 3.  { + (1) A person commits the crime of providing
drug test falsification equipment if the person intentionally
delivers, possesses with intent to deliver or manufactures with
intent to deliver a substance or device designed to enable a
person to falsify the results of a drug test.
  (2) Providing drug test falsification equipment is a Class A
misdemeanor. + }
