SUMMARY

Expands offense of reckless driving to include driving at speed
{ - greater than 95 - } { + over 30 + } miles per hour { + in
excess of designated speed limit or posted speed + }. Punishes by
possible license suspension and by maximum of one year of
imprisonment, $5,000 fine, or both. { + Exempts operator of
emergency vehicle. + }
A BILL FOR AN ACT
Relating to reckless driving; amending ORS 811.140.
Be It Enacted by the People of the State of Oregon:
SECTION 1. ORS 811.140 is amended to read:
811.140. (1) A person commits the offense of reckless driving
if the person { - recklessly - } drives a vehicle upon a
highway or other premises described in this section { + :
(a) Recklessly + } in a manner that endangers the safety of
persons or property { - . - } { + ; or
(b) At a rate of speed over 30 miles per hour in excess of the
designated speed limit or any posted speed. This paragraph does
not apply to an operator of an emergency vehicle in the course of
the operator's official duty. + }
(2) The use of the term 'recklessly' in this section is as
defined in ORS 161.085.
(3) The offense described in this section, reckless driving, is
a Class A misdemeanor and is applicable upon any premises open to
the public.
