SUMMARY

Repeals sunset on law providing that certain nonprofit
facilities and training homes are public bodies for purposes of
limitations on liability of public body.
Declares emergency, effective on passage.
A BILL FOR AN ACT
Relating to liability of public bodies; amending section 4,
chapter 579, Oregon Laws 1997; repealing section 3, chapter
579, Oregon Laws 1997; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + Section 3, chapter 579, Oregon Laws 1997, is
repealed. + }
SECTION 2. Section 4, chapter 579, Oregon Laws 1997, is amended
to read:
{ + Sec. 4. + } Section 2 { + , chapter 579, Oregon Laws
1997, + } { - of this Act - } applies only to causes of
{ - actions - } { + action + } that arise on or after
{ - the effective date of this Act - } { + October 4,
1997. + } { - and before December 31, 2001. Notwithstanding the
repeal of section 2 of this Act by section 3 of this Act, any
cause of action that arises on or after the effective date of
this Act and before December 31, 2001, shall continue to be
governed by ORS 30.260 to 30.300 on and after December 31, 2001,
as though section 2 of this Act had not been repealed. - }
SECTION 3. { + This 2001 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2001 Act takes effect on its
passage. + }
