  Prohibits carrying animal on external part of vehicle except
under specified circumstances. Punishes by maximum fine of $75.
 
                        A BILL FOR AN ACT
Relating to transportation of animals; creating new provisions;
  and repealing ORS 811.200.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + Section 2 of this 2001 Act is added to and made
a part of ORS chapter 811. + }
  SECTION 2.  { + (1) A person commits the offense of carrying an
animal on the external part of a motor vehicle if the person is
operating a motor vehicle on the highway and the person is
carrying an animal in a space in the motor vehicle intended for a
load.
  (2) Notwithstanding subsection (1) of this section, a person
may carry an animal on the external part of a motor vehicle if
the animal is:
  (a) Cross tethered to the motor vehicle.
  (b) Protected by a secured container or cage in a manner that
will prevent the animal from falling, jumping or being thrown
from the motor vehicle.
  (c) Livestock.
  (d) A dog and the motor vehicle is on a highway that is not a
highway with an interstate designation and that is not within the
city limits of a city with a population of 5,000 or more if:
  (A) The dog is being transported for ranching or farming
purposes; or
  (B) The owner of the dog is operating the motor vehicle and
either owns or is employed by a ranching or farming operation.
  (3) The offense described in this section, carrying an animal
on the external part of a motor vehicle, is a Class D traffic
violation. + }
  SECTION 3.  { + ORS 811.200 is repealed. + }
