                     SENATE MINORITY REPORT
                          AMENDMENTS TO
                   A-ENGROSSED HOUSE BILL 2714

President Derfler:
  A minority of your Committee on Rules and Redistricting, to
whom was referred A-engrossed House Bill 2714, having had the
same under consideration, respectfully reports it back with the
recommendation that it do pass with the following amendments:
 
  On page 1 of the printed A-engrossed bill, line 2, after '
zones' insert a period and delete the rest of the line.
  Delete lines 4 through 25 and delete pages 2 through 16 and
insert:
  '  { +  SECTION 1. + }  { + Section 2 of this 2001 Act is added
to and made a part of ORS chapter 215. + }
  '  { +  SECTION 2. + }  { + (1) If the Land Conservation and
Development Commission adopts rules that allow for the approval
of one primary farm dwelling customarily provided in conjunction
with farm use based on the gross farm income earned from the farm
unit, the commission shall:
  ' (a) Provide for adjustment of the gross farm income standard
based on an inflation index that reflects the change in value of
agricultural commodities; and
  ' (b) Allow the farm operator to meet the gross farm income
standard by aggregating the farm operator's gross annual farm
income from the farm unit.
  ' (2) The gross annual farm income produced from a lot or
parcel may not be used to qualify more than one primary farm
dwelling under this section.
  ' (3) As used in this section, 'farm unit' means all contiguous
and noncontiguous tracts of land in common ownership that are
used by the farm operator for farm use. + }
  '  { +  SECTION 3. + }  { + Section 2 of this 2001 Act applies
to rules adopted by the Land Conservation and Development
Commission before, on or after the effective date of this 2001
Act. + } ' .
