    { - Requires Land Conservation and Development Commission to
adopt certain rules for authorization of dwellings in areas zoned
for exclusive farm use. Provides that, when establishing
standards for authorization of dwelling in conjunction with farm
use on land managed as part of farm operation not smaller than
minimum lot size, commission must adopt rules that take into
consideration capability of lot or parcel, including size and
soil class, agricultural activities on adjacent lots or parcels
and other relevant factors. - }

when adopting rules allowing farm dwelling on land zoned for farm
use based upon gross farm income, to provide for inflation and to
allow farm operator to meet gross farm income standard by
aggregating operator's gross annual farm income from all
contiguous and noncontiguous tracts of land in common ownership
that are used by operator for farm use. + }
 
                        A BILL FOR AN ACT
Relating to farm dwellings in exclusive farm use zones.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + Section 2 of this 2001 Act is added to and made
a part of ORS chapter 215. + }
  SECTION 2.  { + (1) If the Land Conservation and Development
Commission adopts rules that allow for the approval of one
primary farm dwelling customarily provided in conjunction with
farm use based on the gross farm income earned from the farm
unit, the commission shall:
  (a) Provide for adjustment of the gross farm income standard
based on an inflation index that reflects the change in value of
agricultural commodities; and
  (b) Allow the farm operator to meet the gross farm income
standard by aggregating the farm operator's gross annual farm
income from the farm unit.
  (2) The gross annual farm income produced from a lot or parcel
may not be used to qualify more than one primary farm dwelling
under this section.
  (3) As used in this section, 'farm unit' means all contiguous
and noncontiguous tracts of land in common ownership that are
used by the farm operator for farm use. + }
  SECTION 3.  { + Section 2 of this 2001 Act applies to rules
adopted by the Land Conservation and Development Commission
before, on or after the effective date of this 2001 Act. + }
