Requires health benefit plans that cover prescription drugs to
issue uniform prescription drug identification cards. Provides
exceptions.
A BILL FOR AN ACT
Relating to uniform prescription drug identification cards.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + As used in sections 1 to 6 of this 2001 Act:
(1) 'Device' has the meaning given that term in ORS 689.005.
(2) 'Enrollee' has the meaning given that term in ORS 743.730.
(3) 'Health benefit plan' has the meaning given that term in
ORS 743.730.
(4) 'Prescription drug' has the meaning given that term in ORS
689.005. + }
SECTION 2. { + (1) A health benefit plan that provides
coverage for prescription drugs or devices and that issues a
prescription drug card shall issue to its enrollees a uniform
prescription drug identification card. The uniform prescription
drug identification card must contain the information listed in
paragraphs (a) to (g) of this subsection in the following order,
beginning at the top left margin of the card:
(a) The name of the health benefit plan and its logo;
(b) The American National Standards Institute assigned Issuer
Identification Number;
(c) The processor control number;
(d) The enrollee's group number;
(e) The health benefit plan's card issuer identifier;
(f) The enrollee's identification number; and
(g) The enrollee's name.
(2) In addition to the information required under subsection
(1) of this section, the uniform prescription drug identification
card must contain, in one of the lower-most elements on the back
side of the card, the following information specific to the
health benefit plan:
(a) The claims submission office name and address; and
(b) The help desk telephone number.
(3) Nothing in this section requires a health benefit plan to
violate a contractual agreement, service mark agreement or
trademark agreement. + }
SECTION 3. { + A health benefit plan shall issue a + }
{ + uniform prescription drug identification card to an enrollee
upon enrollment or upon any change in the enrollee's coverage
that impacts the data contained on the card. A change in the
enrollee's coverage includes but is not limited to the addition
or deletion of a dependent of the enrollee covered by the health
benefit plan. + }
SECTION 4. { + Not later than January 1, 2005, the uniform
prescription drug identification cards provided under section 2
of this 2001 Act shall contain one of the following mediums
capable of processing or adjudicating a claim electronically:
(1) A magnetic strip;
(2) A bar code; or
(3) Any new technology available that is capable of processing
or adjudicating a claim electronically. + }
SECTION 5. { + (1) Sections 1 to 4 of this 2001 Act do not
apply to an entity that maintains its own facilities and employs
or contracts with physicians, pharmacists, nurses and other
health care personnel to the extent that the entity dispenses
prescription drugs or devices from its own pharmacies to its
employees and to enrollees of its health benefit plan.
(2) Sections 1 to 4 of this 2001 Act do not apply to a health
benefit plan that issues a single identification card to its
enrollees for all services covered under the plan. + }
SECTION 6. { + The Director of the Department of Consumer and
Business Services shall adopt rules to implement sections 1 to 4
of this 2001 Act. + }
SECTION 7. { + Sections 1 to 4 of this 2001 Act apply to
health benefit plans that are issued or renewed on or after the
effective date of this 2001 Act. + }
