SUMMARY

brief statement of the essential features of the measure as
introduced.
Directs Water Resources Department to complete existing well
network survey and make results available to public.
Declares emergency, effective on passage.
A BILL FOR AN ACT
Relating to ground water surveying; and declaring an emergency.
Whereas the Legislative Assembly finds that monitoring ground
water is essential for maintaining a safe and adequate supply of
ground water and for protecting Oregon's aquifers for present and
future uses; and
Whereas the Legislative Assembly finds that a ground water
database that includes long term data on ground water is
necessary for proper management of ground water in this state;
and
Whereas the Legislative Assembly finds that such a database
helps provide a safe and adequate supply of ground water for
human consumption while conserving the maximum beneficial use,
without waste, for agricultural, commercial, industrial, thermal,
recreational and other beneficial uses; now, therefore,
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + Section 2 of this 2001 Act is added to and made
a part of ORS 537.505 to 537.795. + }
SECTION 2. { + (1) Pursuant to rules adopted by the Water
Resources Commission, the Water Resources Department shall survey
the existing well network of the state. The survey shall include
only those wells that are monitored on an annual or more frequent
basis.
(2) The information collected by the department for each well
pursuant to this section shall include, but not be limited to:
(a) Well location;
(b) Well ownership;
(c) Static water level measurements;
(d) Measurement protocol;
(e) Well log information; and
(f) Well identification number.
(3) The department shall compile the information collected in
the survey and make it available to the public in written and
electronic form. The electronic format used by the department
shall include utilizing the World Wide Web to provide information
in commonly used data formats.
(4) The department may consult with the ground water advisory
committee established pursuant to ORS 536.090 in determining the
most effective manner of providing the information collected
under this section. + }
SECTION 3. { + The Water Resources Department shall complete
the survey required under section 2 of this 2001 Act by June 30,
2002. + }
SECTION 4. { + Section 3 of this 2001 Act is repealed June 30,
2002. + }
SECTION 5. { + This 2001 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2001 Act takes effect on its
passage. + }
