Provides refund of tax paid on certain alternative fuels used
to propel motor vehicles.
A BILL FOR AN ACT
Relating to use fuel taxes.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + Section 2 of this 2001 Act is added to and made
a part of ORS 319.510 to 319.880. + }
SECTION 2. { + (1) A user who pays the use fuel tax imposed
under ORS 319.510 to 319.880 on a fuel other than diesel fuel may
apply for a refund of the tax paid.
(2) The Department of Transportation shall adopt rules
establishing the procedure for applications for refunds under
this section.
(3) The department shall refund the amount of tax paid to any
person who establishes, to the satisfaction of the department,
that the person has paid the use fuel tax on a fuel other than
diesel fuel. + }
SECTION 3. { + The Legislative Assembly shall repeal section 2
of this 2001 Act when the Department of Transportation informs
the Legislative Assembly that 10 percent of the motor vehicles
registered in Oregon use something other than gasoline or diesel
fuel for propulsion. + }
SECTION 4. { + Section 2 of this 2001 Act applies to taxes
paid on or after the effective date of this 2001 Act. + }
