Provides that court in civil action may not make award of
attorney fees to public body that exceeds actual cost of legal
services.
A BILL FOR AN ACT
Relating to awards of attorney fees to public bodies.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + Notwithstanding ORS 20.075 or any other
provision of law, a court, in any civil action, may not make an
award of attorney fees to a public body, as defined in ORS
30.260, that exceeds the actual cost to the public body for the
legal services rendered in the case. + }
SECTION 2. { + Section 1 of this 2001 Act applies only to
awards of attorney fees made on or after the effective date of
this 2001 Act. + }
