SUMMARY

Allows retired member of Public Employees Retirement System who
is elected as sheriff or hired as police chief to elect to
continue to receive retirement allowance while serving as sheriff
or police chief. Provides that retired member may not receive
creditable service for period of service as sheriff or police
chief.
A BILL FOR AN ACT
Relating to public employee retirement.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + Section 2 of this 2001 Act is added to and made
a part of ORS chapter 238. + }
SECTION 2. { + Notwithstanding any other provision of this
chapter, a retired member of the Public Employees Retirement
System who is elected as a sheriff or hired as a police chief may
elect to continue to receive the retirement allowance provided by
this chapter while serving as sheriff or police chief. A retired
member who makes an election to continue to receive the
retirement allowance under this section is entitled to receive
the retirement allowance provided by this chapter during the
period of service as sheriff or police chief, but may not make
contributions to the Public Employees Retirement Fund or acquire
any creditable service by reason of the period of service. The
public employer employing the retired member shall not make
contributions to the fund on behalf of the retired member during
the period of service. An election under this section must be
made in writing and be provided to the Public Employees
Retirement Board within 60 days after the retired member is
elected or hired. + }
