SUMMARY

Requires Department of State Police to make courses for
training police officers in chemical analyses of person's breath
available to corrections officers and parole and probation
officers. Requires department to certify corrections and parole
and probation officers upon satisfactory completion of course.
A BILL FOR AN ACT
Relating to chemical analyses of person's breath.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + (1) As used in this section, 'corrections
officer' and 'parole and probation officer' have the meanings
given those terms in ORS 181.610.
(2) The Department of State Police shall make the training
courses required by ORS 813.160 (1)(b) available to corrections
officers and parole and probation officers.
(3) The department shall issue permits to corrections officers
and parole and probation officers according to their
qualifications. The department shall issue a permit to a
corrections officer or a parole and probation officer only upon
satisfactory completion of the prescribed training course and
written examination. A permit must state the methods and
equipment that the corrections officer or parole and probation
officer is qualified to use. Permits are subject to termination
or revocation at the discretion of the Department of State
Police.
(4) When an officer issued a permit under this section performs
a chemical analysis of breath, the officer shall prepare and sign
a written report of the findings of the test that includes the
identification of the person upon whose request the test was
administered. + }
