SUMMARY
The following summary is not prepared by the sponsors of the

consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.
Creates offense of operating a motor vehicle while using a
mobile telephone or portable computer. Defines mobile telephone
and portable computer.
Punishes by maximum fine of $300 or, if commission of offense
results in bodily injury or property damage, by maximum fine of
$600.
A BILL FOR AN ACT
Relating to driving while using an electronic device.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + Section 2 of this 2001 Act is added to and made
a part of ORS chapter 811. + }
SECTION 2. { + (1) A person commits the offense of operating a
motor vehicle while using a mobile telephone or portable computer
if the person uses a mobile telephone or portable computer while
operating a motor vehicle on a highway.
(2) As used in this section:
(a) 'Mobile telephone' means a handheld device designed to
receive and transmit voice communication. A citizens band radio
or other two-way radio is not a 'mobile telephone. '
(b) 'Portable computer' means a laptop computer or a handheld
computer.
(3) The offense described in this section, operating a motor
vehicle while using a mobile telephone or portable computer, is a
Class B traffic violation, except that if commission of the
offense results in bodily injury or property damage, the offense
is a Class A traffic violation. + }
