                             SUMMARY
 
The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure.
 
  Establishes goal for number of school nurses employed by school
districts. Directs Department of Education to award grants to
school districts for costs of employing school nurses.
  Allocates moneys received by Oregon under tobacco Master
Settlement Agreement of 1998 to Department of Education for
grants.
 
                        A BILL FOR AN ACT
Relating to school nurses.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + (1) As used in this section, 'school nurse '
means a registered nurse who works in a public school setting and
who provides direct health care services.
  (2) There is established a statewide goal to provide at least
one full-time equivalent (FTE) school nurse for every 1,000
students enrolled in the schools of each school district.
  (3) Pursuant to rules adopted by the State Board of Education,
the Department of Education may award grants to school districts
to assist with the costs of employing school nurses.
  (4) The department shall award grants based on applications
submitted by school districts. The department shall award grants
to those school districts that will meet the nursing goal
established by subsection (2) of this section after receiving the
grant. School districts that receive a grant under this section
shall be required to match the grant amount, providing one dollar
in matching funds for every one dollar of grant funds.
  (5) A school district that receives a grant under this section
may use the grant to contract with an education service district
to provide school nurses.
  (6) A school district may apply for and receive a grant each
year.
  (7) The board shall establish a state school nurse consultant
position within the department to oversee the grant program
created by this section. The state school nurse consultant shall
be a registered nurse who has experience as a school nurse and
 
who is certified by the Teacher Standards and Practices
Commission under ORS 342.475.
  (8) The board shall adopt rules, in consultation with the
Oregon State Board of Nursing, to administer the grant program.
The rules shall include the procedures and criteria for receiving
a grant. + }
  SECTION 2.  { + In each biennium during the period in which
United States tobacco products manufacturers make payments to
this state under the Master Settlement Agreement of 1998, $_____
of the moneys received by this state shall be allocated to the
Department of Education for awarding grants under section 1 of
this 2001 Act to school districts to assist with the costs of
employing school nurses. + }
