                             SUMMARY
 
The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.
 
  Requires person to have vehicle dealer certificate if person
regularly provides for compensation real property for display of
vehicles. Punishes violation by maximum imprisonment of one year,
$5,000 fine, or both. Subjects person to civil penalty for
violation.
 
                        A BILL FOR AN ACT
Relating to vehicle dealer certificates; amending ORS 822.005.
Be It Enacted by the People of the State of Oregon:
  SECTION 1. ORS 822.005 is amended to read:
  822.005. (1) A person commits the offense of acting as a
vehicle dealer without a certificate if the person is not the
holder of a valid, current vehicle dealer certificate issued
under ORS 822.020 and the person:
  (a) Buys, sells, brokers, trades or exchanges vehicles either
outright or by means of any conditional sale, bailment, lease,
security interest, consignment or otherwise;
  (b) Displays a new or used vehicle, trailer, semitrailer or
manufactured structure for sale;   { - or - }
  (c) Acts as any type of agent for the owner of a vehicle to
sell the vehicle or acts as any type of agent for a person
interested in buying a vehicle to buy a vehicle { + ; or
  (d) Rents, leases or provides for compensation any real
property regularly used to publicly display vehicles for sale. As
used in this paragraph, 'regularly' means for more than 30 days
in a 12-month period + }.
  (2) This section does not apply to persons or vehicles exempted
from this section under ORS 822.015.
  (3) The offense described in this section, acting as a vehicle
dealer without a certificate, is a Class A misdemeanor.
