                             SUMMARY

  Directs Mental Health and Developmental Disability Services
Division to develop plan for delivering mental health services to
people incarcerated in state and local correctional facilities.
  Declares emergency, effective on passage.
 
                        A BILL FOR AN ACT
Relating to mental health services; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + (1) As used in this section:
  (a) 'Community mental health and developmental disabilities
program' means a program established pursuant to ORS 430.620.
  (b) 'Local correctional facility' has the meaning given that
term in ORS 169.005.
  (2) The Mental Health and Developmental Disability Services
Division, in consultation with the Department of Corrections, the
Oregon Youth Authority, county and city governing bodies and
community mental health and developmental disabilities programs,
shall develop plans for delivering mental health services to
persons who are incarcerated in state and local correctional
facilities.
  (3) The plans developed under subsection (2) of this section
must address the delivery of therapy services and medications
including, but not limited to, the ability of local correctional
facilities to administer medications.
  (4) The division shall report to the Seventy-second Legislative
Assembly. The report must include the plans developed under
subsection (2) of this section and any legislative
recommendations necessary to implement the plans. + }
  SECTION 2.  { + This 2001 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2001 Act takes effect on its
passage. + }
