                             SUMMARY

  Requires building designers to register with Department of
Consumer and Business Services.   { - Requires three years of
experience as general contractor prior to registration. - }
Requires six hours of continuing education for building
designers. Exempts registered architects and engineers.
 
                        A BILL FOR AN ACT
Relating to building designers.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + Section 2 of this 2001 Act is added to and made
a part of ORS chapter 455. + }
  SECTION 2.  { + (1) A person may not engage in the business or
practice of preparing building designs for buildings described in
ORS 671.030 (2) and 672.060 (10) that are site constructed unless
the person is registered with the Department of Consumer and
Business Services.
  (2) A person registered as a building designer under this
section may produce plans and specifications for buildings
described in ORS 671.030 (2) and 672.060 (10), either in pursuit
of the registrant's own business or for a person with whom the
registrant is under contract or employed. The plans and
specifications may not be sold, traded or otherwise conveyed to a
third party for use by the third party in constructing a building
or developing other plans and specifications.
  (3)(a) The Director of the Department of Consumer and Business
Services shall by rule establish a registration system for
building designers. The registration system shall provide for
initial registration and periodic reregistration.
  (b) As a condition of reregistration, the director shall
require a registrant to demonstrate not fewer than six hours
annually of continuing education in the One and Two Family
Dwelling Code adopted under ORS 455.610 or the structural code as
defined in ORS 455.010.
  (4) The provisions of this section do not apply to a person
registered as an architect under ORS 671.020 or as an engineer
under ORS 672.020.
 
  (5) The director may adopt registration fees as reasonable and
necessary for the administration and enforcement of this
section. + }
