Authorizes Office for Oregon Health Plan Policy and Research to
sponsor studies of health care utilization and quality
improvement.
Declares emergency, effective July 1, 2001.
A BILL FOR AN ACT
Relating to Office for Oregon Health Plan Policy and Research;
creating new provisions; amending ORS 414.019 and 442.460;
appropriating money; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. ORS 414.019 is amended to read:
414.019. As used in ORS 414.018 to 414.024, 414.042, 414.107,
414.710, 414.720 and 653.747, as of November 4, 1993, 'Oregon
Health Plan' means chapter 815, Oregon Laws 1993, and the
{ - seven - } { + eight + } pieces of legislation enacted
during the 1987, 1989 { + , + } { - and - } 1991 { + and
2001 + } legislative sessions, the goal of which is to assure
Oregonians access to { + affordable and sustainable + } health
care coverage, including the high-risk pool created by chapter
838, Oregon Laws 1989, the employer-based coverage reforms
contained in chapter 591, Oregon Laws 1987, chapter 381, Oregon
Laws 1989, and chapter 916, Oregon Laws 1991, the cost
containment and technology assessments contained in chapter 470,
Oregon Laws 1991 { + , and ORS 442.460, as amended by section 2
of this 2001 Act + }, and the prioritization and medical
assistance reforms contained in chapter 836, Oregon Laws 1989,
and chapter 753, Oregon Laws 1991.
SECTION 2. ORS 442.460 is amended to read:
442.460. { + (1) + } In order to obtain regional or statewide
data about the utilization and cost of health care services
{ - , - } { + and quality improvement, + } the Office for
Oregon Health Plan Policy and Research may accept information
relating to the utilization and cost of health care services
identified by the Administrator of the Office for Oregon Health
Plan Policy and Research from physicians, insurers or other
third-party payers or employers or other purchasers of health
care.
{ + (2) The office may sponsor quantitative, population-based
studies, investigations and projects designed to:
(a) Identify the magnitude of unnecessary variation in discrete
medical practices, postulate the cause of the variation and
develop strategies to reduce the variation in health care
delivery systems and markets in Oregon;
(b) Evaluate certain evidence-based medical protocols and other
methodologies that hold promise for improving medical outcomes
and the cost-effectiveness of medical care, and disseminate such
protocols and methodologies to health care delivery systems and
markets in Oregon; and
(c) Improve the consistency and effectiveness of medical
interventions, including but not limited to the appropriate
clinical use of emerging medical technologies.
(3) The office may:
(a) Develop study objectives and methodologies;
(b) Develop public and private partnerships among interested
health care purchasing, financing and delivery entities;
(c) Contract with appropriate organizations to conduct studies,
investigations or projects;
(d) Monitor the performance of the contracts; and
(e) Disseminate the findings of the studies, investigations and
projects.
(4) The administrator shall determine whether a conflict of
interest exists with an entity that may cosponsor a study,
investigation or project. The administrator shall ensure that a
conflict of interest that would impair the objectivity and
credibility of a study, investigation or project in design,
performance or findings as a result of the cosponsorship does not
exist with a cosponsor.
(5) The office shall develop and adopt procedures for awarding
grants to successful entities to conduct the studies,
investigations and projects described in subsection (2) of this
section.
(6) The administrator may appoint one or more advisory
committees to assist in the development, awarding and monitoring
of grant proposals issued by the office. The membership of an
advisory committee shall represent the various disciplines
necessary for the development and performance of objective and
credible studies, investigations and projects. The members of an
advisory committee shall serve without compensation. + }
SECTION 3. { + (1) The Office for Oregon Health Plan Policy
and Research Account is established separate and distinct from
the General Fund. All moneys in the fund are continuously
appropriated to the Office for Oregon Health Plan Policy and
Research to be expended for sponsoring studies, investigations
and projects related to health care utilization and quality
improvement.
(2) The Office for Oregon Health Plan Policy and Research
Account shall consist of:
(a) Moneys appropriated to the account by the Legislative
Assembly;
(b) Grants from federal, state and local governmental agencies
involved in purchasing health care services;
(c) Grants from federal and state governmental agencies,
institutions of higher education and not-for-profit foundations
involved in health services research;
(d) Grants from not-for-profit and for-profit organizations
involved in the purchasing, financing or delivery of health care
services as long as there is no conflict of interest due to a
source of funding in the design, performance or findings of a
study, investigation or project; and
(e) Interest earnings on moneys in the account. + }
SECTION 4. { + The Administrator of the Office for Oregon
Health Plan Policy and Research shall report, by January 15 of
each odd-numbered year, to the Legislative Assembly and the
Governor on the studies, investigations and projects conducted
under the provisions of ORS 442.460, as amended by section 2 of
this 2001 Act. + }
SECTION 5. { + This 2001 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2001 Act takes effect July 1,
2001. + }
