  Requires Department of Transportation to use $25 million from

                        A BILL FOR AN ACT
Relating to highway construction; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + (1) The Department of Transportation shall use
$25 million from the proceeds of the bonds issued under ORS
367.620 (2), created by section 1, chapter ___, Oregon Laws 2001
(Enrolled House Bill 2142), for a program, the purpose of which
is to match moneys that the governing body of a city or county is
willing to spend from its own funds for projects on state
highways.
  (2) The governing body of a city or county that proposes to
contribute its own moneys for at least 50 percent of the cost of
a project on a state highway in the jurisdiction of the city or
county may apply to the department for matching funds.
  (3) For purposes of this section, moneys distributed to a
county or a city by the department, including but not limited to
moneys distributed to a county under ORS 366.525 or to a city
under ORS 366.800, may not be considered to be the county's or
the city's own moneys.
  (4) The maximum amount the department may contribute to one
project is $5 million. The maximum amount the department may
contribute to one county is $5 million.
  (5) The department may not contribute to a project under this
section unless:
  (a) The amount contributed by the city or county, matched by
the amount applied for from the department, is sufficient to
complete the project; and
  (b) The project complies with all applicable federal, state and
local laws and regulations.
  (6) The department shall develop an application process for
awards under this section and shall specify criteria by which
projects will be chosen if the department receives more
applications that qualify for funds under this section than the
department has moneys available under this section to fund. + }
  SECTION 2.  { + Section 1 of this 2001 Act becomes operative
only if House Bill 2142 becomes law. + }
  SECTION 3.  { + This 2001 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2001 Act takes effect July 1,
2001. + }
