SUMMARY

Creates certain requirements for { - removal and remediation
actions relating to Willamette River and for disposal of toxic or
hazardous substances on Ross and Hardtack Islands - } { +
disposal within lagoon at Ross Island + }.
Declares emergency, effective on passage.
A BILL FOR AN ACT
Relating to Willamette River; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + Section 2 of this 2001 Act is added to and made
a part of ORS 465.200 to 465.510. + }
SECTION 2. { + Notwithstanding any other provision of ORS
465.200 to 465.510:
(1) For any proposed disposal within the lagoon at Ross Island,
the Department of Environmental Quality shall require analytical
samples sufficient to characterize the nature of the material
proposed for disposal.
(2) Material may be disposed of in the lagoon at Ross Island if
the department determines that hazardous substances in the
material do not exceed concentrations recognized by the
department for protection of human health and the environment.
(3) The Environmental Quality Commission may adopt
administrative rules that specify the criteria to be used for
approval of any proposed disposal. + }
SECTION 3. { + Section 2 of this 2001 Act applies to actions
occurring on or after the effective date of this 2001 Act. + }
SECTION 4. { + This 2001 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2001 Act takes effect on its
passage. + }
