On page 1 of the printed bill, line 2, after '457.440; ' insert
'and appropriating money.' and delete the rest of the line and
line 3.
In line 5, delete 'Section 2 of this 2001 Act is' and insert
'Sections 2 to 2d of this 2001 Act are'.
In line 6, delete 'this section' and insert 'sections 2 to 2d
of this 2001 Act'.
After line 6, insert:
' (a) 'Capital project' has the meaning given that term in ORS
280.060.'.
In line 7, delete '(a)' and insert '(b)'.
In line 14, delete '(b)' and insert '(c)'.
On page 2, after line 2, insert:
' { + SECTION 2a. + } { + (1) Each school district that
imposes operating taxes on the exception value of the district
shall contribute 20 percent of the amount of operating taxes to
the School Capital Project Fund established under section 2c of
this 2001 Act.
' (2) Contributions to the fund shall be made in the manner
prescribed in section 2b of this 2001 Act.
' (3) A school district's contributions to the School Capital
Project Fund are declared to be a public purpose for which the
school district was organized and for which the school district
may make expenditures. + }
' { + SECTION 2b. + } { + (1) The county assessor shall
report 20 percent of the amount reported to the Department of
Revenue for each school district under section 2 (4) of this 2001
Act to the county tax collector.
' (2) The county tax collector shall incorporate the amount
reported under subsection (1) of this section in the distribution
percentage schedule prepared pursuant to ORS 311.390 so that
distributions from the unsegregated tax collections account
include distributions for each school district to the School
Capital Project Fund established under section 2c of this 2001
Act.
' (3) At the time that the county treasurer makes unsegregated
tax collections account distributions under ORS 311.395 (6), the
county treasurer shall transfer an amount determined in
accordance with the distribution percentage schedule, as computed
under ORS 311.390 and subsection (2) of this section, to the
State Treasurer. The State Treasurer shall deposit moneys
received from county treasurers under this section into the
School Capital Project Fund. + }
' { + SECTION 2c. + } { + (1) The School Capital Project
Fund is established in the State Treasury, separate and distinct
from the General Fund. Earnings of the School Capital Project
Fund shall accrue to the School Capital Project Fund.
' (2) Moneys in the School Capital Project Fund are
continuously appropriated to the Department of Education for the
purpose of awarding capital project grants under section 2d of
this 2001 Act. + }
' { + SECTION 2d. + } { + (1) School districts that
undertake capital projects may seek capital project grant moneys
from the School Capital Project Fund by applying to the
Department of Education.
' (2) The application shall be submitted in the time and manner
prescribed by the Department of Education and shall contain the
information required by the department.
' (3) The Department of Education shall by rule prescribe the
criteria under which a capital project grant may be awarded to a
school district, and shall award grants based on the extent to
which proposed capital projects meet the criteria established by
the department.
' (4) Capital project grants awarded to a school district may
be spent by the district only on capital projects undertaken by
the district. + } ' .
