                             SUMMARY
 
The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.
 
  Creates civil immunity for owner of firearm used to cause
injuries if firearm was taken without permission or stolen from
owner.
  Refers Act to people for their approval or rejection at next
regular general election.
 
                        A BILL FOR AN ACT
Relating to firearms; and providing that this Act shall be
  referred to the people for their approval or rejection.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + (1) The owner of a firearm is immune from civil
liability for injuries caused by the use of the firearm if:
  (a) The owner stored the firearm in a safe manner; and
  (b) The firearm was not in the possession of the owner at the
time the injuries were caused because the firearm had been taken
without the consent of the owner or had been stolen from the
owner.
  (2) For purposes of this section, a firearm is stored in a safe
manner if:
  (a) The firearm is stored in a place where an unsupervised
minor could not reasonably have been expected to gain access;
  (b) The firearm is stored in a locked container; or
  (c) A lock has been installed on the firearm to prevent its
normal function and discharge. + }
  SECTION 2.  { + This 2001 Act shall be submitted to the people
for their approval or rejection at the next regular general
election held throughout this state. + }
