SUMMARY
The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.
Allows member of Public Employees Retirement System to acquire
up to four years of retirement credit for service with public
body, including service with public bodies in other states and
federal government, if member did not receive credit for period
of service under Public Employees Retirement System or other
public retirement plan. Requires that member pay to Public
Employees Retirement Board full cost of benefits attributable to
credit acquired.
A BILL FOR AN ACT
Relating to public employee retirement; creating new provisions;
and repealing ORS 238.162.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + Section 2 of this 2001 Act is added to and made
a part of ORS chapter 238. + }
SECTION 2. { + (1) For the purposes of this section, 'public
body' means the federal government and any state, state agency,
city, county, municipal corporation, public corporation or other
political subdivision of a state.
(2) Except as provided in subsection (4) of this section, a
member of the Public Employees Retirement System is entitled to
receive retirement credit as provided in subsection (3) of this
section if:
(a) The member was employed by a public body at any time before
becoming a member of the system;
(b) The public body that employed the member was not a
participating public employer at the time the member was employed
by the public body, or the public body was a participating public
employer for the purpose of some but not all employees of the
employer and the member belonged to a class of employees for
which membership in the system was not provided; and
(c) The member makes the payment required by subsection (3) of
this section within the time specified by that subsection.
(3) A member of the system who meets the requirements of
subsection (2) of this section is entitled to receive not more
than four years of retirement credit for the period of the
member's service with the public employer described in subsection
(2) of this section if within 90 days before the member's
effective date of retirement the member:
(a) Applies in writing to the Public Employees Retirement Board
for such retirement credit;
(b) Provides written verification to the board from the public
body that employed the member, verifying the period of time that
the member was in the active service of the public body; and
(c) Pays to the board, in a lump sum, for each year of
retirement credit applied for under this section, an amount
determined by the board to represent the full cost to the system
of providing the retirement credit to the member.
(4)(a) A member may not receive retirement credit under the
provisions of this section for any period of service with a
public body if the member is entitled to a pension or retirement
allowance by reason of that service under a public plan or system
offered by the public body.
(b) A member may not receive retirement credit under the
provisions of this section for any period of service with a
public body if the member receives credit for the same period of
time under any other provision of this chapter. A member may not
receive credit under any other provision of this chapter for any
period of service for which the member receives retirement credit
under this section. + }
SECTION 3. { + ORS 238.162 is repealed. + }
SECTION 4. { + Section 2 of this 2001 Act applies only to
members of the Public Employees Retirement System whose effective
date of retirement is on or after the effective date of this 2001
Act. + }
